Subject:- Sixth Central Pay Commission's recommendations -
amendment of Service Rule..s. – regarding
This Department in OM No.AB1401716112008-Estt(RR) dated 24.3.2009 issued the guidelines for amendment of Service Rules/Recruitment Rules for incorporating the changes arising out of 6th CPC recommendations. Separately the revised eligibility conditions for SAG & HAG level for members of Organized Group A Services have been issued in this Department OMS dated 15.12.09 (Non-Technical) and 18.01.201 1 (Engineering Services). The provisions with regard to grant of functional scale of Rs. 14300-18300 (pre-revised) to the SEs and equivalent in respect of Engineering Services prescribed in OM dated 29.12.2010 also refers. Instructions for grant of NFU as per 6'h CPC recommendations have been issued in OM dated 24.4.09
2. As the Recruitment Rules/Service Rules are required to be amended after incorporating the above instructions, all the ministries / Departments / Cadre Controlling Authorities of Organized Group 'A' Services may take immediate necessary action for notification of Service Rules positively by 31.3.2012 in consultation with DOPTIUPSC 8 Ministry of Law.

Anomaly Committee sixth Pay Commission:
The tenure of National Anomaly Committee, set up to look into anomalies arising out of recommendations of Sixth Central Pay Commission, has been extended up to 31st March, 2011.
The National Anomaly Committee is not expected to submit any report. Anomalies are resolved through the process of constructive dialogue and discussion with the representatives of the Staff Side.
This was stated by the Minister of State in the Ministry of Personnel, Public Grievances & Pensions, Shri Prithviraj Chavan in written reply to a question in Rajya Sabha
Earlier it was provided that ex-gratia lump sum compensation to the families of deceased Government servants including from sundry Government sources, such as the Prime Minister's Relief Fund, Chief Minister's Relief Fund, etc. should not exceed the aggregate of Rs. 20 lakhs in each individual case.
The matter has been further reviewed and it has now been decided that there will be no ceiling for grant of ex-gratia lump sum compensation in terms of Department of Pension & Pensioners' Welfare's OM No. OM 45/55/97-P&PW(C) dated 11th September, 1998 read with OM NO.38/37/08- P&PW(A) dated 2nd September, 2008 and OM No.4517/2008-P&PW (F) dated 16th March, 2009.
The above revised provision will be effective from 1.1.2006. All other terms and conditions in the a.M. dated 11th September, 1998 shall remain unchanged. This issues with the concurrence of the Ministry of Finance, Department of Expenditure U.O. No. 361/EV/2010 dated 4th June, 2010.
In so far as persons serving in the Indian Audit &Accounts Department, these orders issue after consultation with the Comptroller & Auditor General of India.

Govt announces major benefits for artisan employees
Government today raised their Grade Pay by partially amending Sixth Pay Commission recommendations implemented in 2008 and restructured the cadre.
Under the new pay scales, Skilled Artisans would be in the Pay Band-I and their Grade Pay would be Rs 1,900.
Highly Skilled Grade I Artisans, who too would be under Pay Band-I, would receive a Grade Pay of Rs 2,800.
Master Craftsman under Pay Band-II would be paid a Grade Pay of Rs 4,200.
Wherever the grade structure in the Industrial as well as Non-Industrial trades is already existing in the ratio of 45:55, the erstwhile Skilled and Highly Skilled, and 25% of Highly Skilled in the grade of Master Craftsman, the following will apply:
1) 45% of the posts may be granted the pay scale of Skilled Worker (Grade pay of Rs. 1900 in the Pay Band PB-1).
2) 25% of remaining 55% may be granted the pay scale of Master Craftsman (Grade Pay of Rs. 4200 in the pay band PB-2);
3) The remaining posts may be divided in a ratio of 50:50 and redesignated as Highly Skilled Worker Grade-II (Grade Pay of Rs. 2400 in pay band PB-1) and Highly Skilled Worker Grade-1 (Grade pay of Rs. 2800 in pay band PB-1).
The placement of the individuals in the posts resulting from the restructuring shall be made w.e.f. 1.1.2006, in relaxation of the conditions, if any, i.e trade test etc. as one time measure. Highly Skilled Grade I shall be en-bloc senior to Highly Skilled Grade II.
The Post of Master Craftsman shall be part of the hierarchy and the placement of Highly Skilled Grade I in the grade of Master Craftsman will be treated as promotion.
In the case of Defence Establishments where there is no category of Skilled Workers and direct recruitment is made 100% at the level of Highly Skilled, the posts of Master Craftsman existing as on 1.1.2006 will be placed in PB-2 + GP-4200 and the remaining posts of Highly Skilled Workers may be bifurcated in HS-I and HS-II in the ratio of 50:50.
The ‘Grade Pay’ for determining the TA/DA entitlement is as indicated in Central Civil Service(Revised Pay) ,Rules 2008.
The term ‘Pay’ for the purpose of these orders refer to basic pay as defined in Rule3(8) of Central Civil Service(Revised Pay)Rules 2008 and includes the revised non-practicing allowance, if any, admissible in addition.
In respect of those employees who opt to continue in their pre-revised scales of pay, the corresponding Grade Pay of the pay sclaes of the post occupied on 1/1/2006 would determine the TA/DA entitlements under these orders. However, for determining the Composite Transfer Grant for such employees, the term pay shall also include, in addition to the basic pay in the pre-revised Scales, stagnation increments, Dearness Pay and NPA as per orders in force on 1/1/2006.The claims submitted in respect of journey made on or after 1st September,2008, may be regulated in accordance with these orders.
It may be noted that no additional funds will be provided on account of revision in TA/DA entitlements. It may therefore be ensured that permission to official travel is given judiciously and restricted only to absolutely essential official requirements.
In so far as the persons serving in the Indian Audit & Accounts Department are concerned, these orders issue in consultation with the Comptroller & Auditor General of India.
Entitlements for Journeys on Tour:

The revised Travel entitlements are subject to following: -
(i) In case of places not connected by rail, travel by AC bus for all those entitled to travel by AC II Tier and above by train and by Deluxe/ordinary bus for others is allowed.
(ii) In case of road travel between places connected by rail, travel by any means of public transport is allowed provided the total fare does not exceed the train fare by the entitled class.
(iii) Henceforth, all mileage points earned by Government employees on tickets purchased for official travel shall be utilized by the concerned department for other official travel by their officers. Any usage of these mileage points for purposes of private travel by an officer will attract departmental action. This is to ensure that the benefits out of official travel, which is funded by the Government, should accrue to the Government.
(iv) All Government servants are allowed to travel below their entitled class of travel.
International Travel Entitlement:

In case of stay/journey on Government ships, boats etc. or journey to remote places on foot/mules etc., for scientific/data collection purposes in organization like FSI, Survey of India, GSI etc., daily allowance will be paid at rate equivalent to that provided tor reimbursement of food bill. However, in this case the amount will be sanctioned irrespective of the actual expenditure incurred on this account with the approval of the Head of Department/controlling officer. For journeys on foot, an allowance of Rs. 5 per kilometer travelled on foot shall be payable additionally.
TA on Transfer:
Accommodation and Mileage Allowance Entitlements:
(i) Accommodation and Mileage Allowance entitlements as prescribed at para 2 above, except for International Travel, for journey on tour by different modes will also be applicable in case of journeys on transfer. The general conditions of admissibility prescribed in S.R. 114 will, however, continue to be applicable.
(ii) The provisions relating to small family norms as contained in para 4(A) of Annexure to M/o Finance O.M. F. No. 10/2/98-IC &F. No. 19030/2/97-EIV dt. 17th April 1998, shall continue to be applicable.
Transfer Grant and Packing Allowance:
(i) The Composite Transfer Grant shall be equal to one month’s pay as defined in para 3 of this O.M. in case of transfer involving a change of station located at a distance of or more than 20 km from each other.
(ii) In cases of transfer to stations which are at a distance of less than 20 kms from the old station and of transfer within the same city, one third of the composite transfer grant will be admissible, provided a change of residence is actually involved.
(iii) At present, only one transfer grant is permitted if the transfer of husband and wife takes place within 6 months of each other from the same place to the same place. With effect from the date of implementation of these orders, in cases where the transfer take place within six months, but after 60 days of the transfer of the spouse, fifty percent of the transfer grant on transfer shall be allowed to the spouse transferred later. No transfer grant shall be admissible to the spouse transferred later in case both the transfers are ordered within 60 days. The existing provisions shall continue to be applicable in case of transfers after a period or six months or more. Other rules precluding transfer grant in case of transfer at own request or transfer other than in public interest, shall continue to apply unchanged in their case.

T.A. Entitlement of Retiring employees:
Transportation of Conveyance:
In partial modification of S.R. 147 the expenditure on transportation of conveyance by government servants on their retirement shall be reimbursed without insisting on the requirement that the possession of the conveyance by them while in service at their last place of duty should have been in public interest.
Lumpsum Transfer Grant and Packing Allowance:
(i) The composite transfer grant equal to a month’s pay last drawn as defined in para 3 of this O.M. may be granted in the case of those employees who, on retirement, settle down at places other than the last station(s) of their duty located at a distance of or more than 20 kms. The transfer incidentals and road mileage for journeys between the residence and the railway station/bus stand, etc. at the old and new station, presently admissible are subsumed in the composite transfer grant and will not be separately admissible.
(ii) As in the case of serving employees, government servants who, on retirement, settle at the last station of duty itself or within a distance of less than 20 kms may be paid one third of the composite transfer grant subject to the condition that a change of residence is actually involved.
The TA/DA rates shall automatically increase by 25% whenever Dearness Allowance payable on the revised pay structure goes up by 50%.

2. LTC
Review of Scheme for Compassionate Appointment in the light of the 6th Pay Commission recommendations
The modification of the existing Scheme for Compassionate Appointment has been considered in the light of the recommendation of the 6th CPC as contained in para 2.2.9 and 2.2.10 of its Report.Accordingly, in partial modification of the Scheme for Compassionate Appointment issued by this Department vide O.M.No.14014/6/94-
Estt.(D) dated gth October, 1998, as amended from time to time.
It has been decided in consultation with the Department of Expenditure that for appointment on compassionate arounds, in exceptional circumstat6es Government may consider- recruiting persons not immediatelv meeting the minimum educational standards.
The Department of Personnel public grievances and Pension's OM No.AB1401716112008-Estt(RR) dated 24.3.2009 issued the guidelines for amendment of Service Rules and Recruitment Rules for incorporating the changes arising out of 6th CPC recommendations.
2. The 6th CPC have also recommended for bringing uniformity in eligibility criteria across various organized Group A Services for promotions. The issue has been examined and in the light of these, it has been decided that the following steps to amend the existing Service Rules shall be undertaken on priority basis:
(i) For promotion to SAG level, the eligibility requirement shall be " Officers in the JAG with 8 years' regular service in the grade including NFSG OR Officers with 17 years' regular service in Group 'A' posts in the service out of which atleast 4 years' regular service should be in the JAG (including service rendered in the NFSG of the JAG."
Over eight lakh state government employees seem to be in no mood to compromise with the state government over the Sixth Pay Commission recommendations.
They have decided to take out a rally from Sardar Baug at Lal Darwaza to Navrangpura on December 6 to mount pressure on the government for its implementation.
Vishnu Patel, the president of the Gujarat State Employees Coordination Committee (GSECC), that the employees will not accept anything but implementation of the recommendations in toto.
He said the government had implemented the recommendations only partially, which was not acceptable to the employees.
Patel said the government had promised to implement the pay panel report just before the last Lok Sabha elections, but it had been delaying it on one pretext or the other.

The Patna University (PU) Syndicate decided to implement the pay scales recommended by the sixth pay commission to its class III and class IV employees. The Syndicate, at its meeting held under the chairmanship of vice-chancellor Shyam Lal, discussed the demand of non-teaching staff in detail and decided to end the discrimination between the payscales of the government staff and the university staff.
Approving a resolution presented by Syndic Rajiv Ranjan Prasad, the Syndicate urged the ex-officio members, the HRD principal secretary and director of higher education, to attend the meetings of the Syndicate and Senate as the HRD department has of late been taking keen interest in the routine activities of the university. Usually these officials do not attend the meetings of various statutory bodies of the university.
The Corporation of the City of Panaji (CCP) informed the high court of Bombay at Goa that it has decided to pay the salaries to its employees as per sixth pay commission.
CCP's advocate Agnelo Diniz told the court that CCP officials have communicated to him that the employees would be paid their salaries as per the Sixth Pay Commission's recommendations.
Earlier according to which encashment of leave in respect & central Government employees will be considered both for earned leave and half pay leave subject to overall limit of 300 days and in respect of encashment of half pay leave, no reduction shall be made on account of pension and pension equivalent of other retirement benefits. In case of shortfall in earned leave, no commutation of half pay leave is permissible. The order was made effective from the lSt September, 2008. The matter was reconsidered in this Department in consultation with the Department of Expenditure (Implementation Cell) and it has been decided to modify the date of effect of this Department's 0.M of even number dated 25th September, 2008 to "O1.01.2006 instead of 01.09.2008 subject to the following conditions:-
Patna High Court directed the state government to enhance the salary structure of the employees of civil courts in the state and make it commensurate with the one recommended by the Sixth pay commission for central govt employees.
From September 1 the state government has promised to implement the sixth pay commission for college and university professors.
This was stated by KS Shastri President of Gujarat State Federation of University and College Teachers' Association. Shastri said that the federation has met education minister Ramanlal Vora and finance minister Vajubhai Vala and it was decided that the sixth pay commission would be implemented from September 1. The resolution for the same will be out by August 15, said Shastri.
He said that the sixth pay commission was already in implementation for all other government employees except professors. He further said that about 10,000 employees would benefit. A professor who has put in 16 years of service will get an hike of about 65-70 per cent in salary while the average hike will be around 40 per cent, claimed Shastri.

The government is actively considering raising the retirement age of all central government employees, including those in the armed forces, from the present 60 to 62 years.
Interestingly, the government conducted a similar exercise last year but shelved the idea, largely because of fears that a higher retirement age would adversely impact employment generation and create resentment in the bureaucracy because of blocked promotional avenues. At that time, it was the Department of Personnel and Training (DoPT) that was asked by the PMO to study the issue and prepare a report.
This year, the finance ministry has come into the picture because of the urgent need to create resources as the government prepares a contingency plan to tackle the fallout of the countrywide drought.
One of the strongest arguments in favour of raising the retirement age is immediate savings for the government in terms of gratuity and pension payments over the next two years. With some 1.5 lakh employees expected to retire in this period, the savings are estimated to be in the region of Rs15,000-20,000 crore.
The Sixth Pay Commission has hugely inflated the government's salary bill, including expenditure on pension. The allocation for pension in the 2009-10 Union budget alone is Rs34,980.35 crore, a 40% increase over last year.
The DoPT, which is the nodal ministry for all administrative decisions related to the bureaucracy, has not come into the picture yet since the move is still at a very preliminary stage. But it is believed to have unofficially conveyed its views about the likely negative impact on the morale of the bureaucracy.
f the decision is finally taken, it will only be the third time the government will have raised the retirement age. Jawaharlal Nehru was the first prime minister to have increased the age of superannuation from 55 to 58 following the 1962 war with China. The Atal Bihari Vajpayee government did it a second time in 1998.
The government has decided to grant Child Adoption Leave for 135 days to female Govemment servant on adoption of a child upto the age of one year, on the lines of matemity leave admissible to natural mothers. Mter implementation of the Sixth Central Pay Commission recommendations, the period of matemity leave was enhanced from 135 days to 180 days. Subsequently, this Department has received representations requesting for enhancement of the period of Child Adoption Leave from 135 days to 180 days in line with the matemity leave. The matter has been examined in this Department and it has been decided to enhance the period of Child Adoption Leave from 135 days to 180 days.
2. A female Govemment servant in whose case the period of 135 days of
Child Adoption Leave has not expired on the date of issue of these orders
shall also be eligible for Child Adoption Leave of 180 days.
3. It has also been decided that a male Govemment servant (including an
apprentice) with less than two surviving children, on valid adoption of a child
below the age of one year, may be sanctioned Patemity Leave for a period of
15 days within a period of six months from the date of valid adoption.
Over 23-lakh employees of the Maharashtra Government, local self-government bodies and teachers would go on an indefinite strike from August 4 to demand parity with Central government staff in allowance as per the Sixth Pay Commission report.
The strike would cover state government staff, zilla parishad employees, gazetted officers, Kulthe said adding the teaching and non-teaching government staffs would also observe a day's strike on July 14.

Given the Sixth Pay Commission recommendations for central government babus, a proportionate increase in salaries of judicial officers, who had demanded a three-fold increase, is on the cards.
But, Justice E Padmanabhan heading the new judicial pay commission, the second one after the first one under Justice Jagannath Shetty, said there would be no delay on his part in meeting the deadline for submitting the recommendations. The Supreme Court had posted the hearing on the matter concerning the pay of subordinate court judges for July 28.
The petition seeking increase in the salary of the trial court judges was filed in the Supreme Court shortly after the Chief Justice of India and judges of the SC and the high courts got a three-fold salary hike earlier this year.
The logic for seeking appointment of a new pay commission was that the first judicial pay commission headed by Justice Shetty had said that whenever there was an upward revision of salaries of HC judges, the salaries of lower court judges should also be proportionately revised.

The Government Doctors’ Association has rejected the sixth pay commission salary hike announced by the government as their main demands had not been considered in the Pay Commission recommendations, state Secretary Senthil said.
Though the government had ordered implementation of the Sixth Pay Commission recommendations, our demands had not been met. “The anomalies were sought to be removed in the new fixation of pay scale. But the same has not been done. Till they are rectified we will not give our approval letter accepting the sixth pay commission recommendation,” he told reporters today.
The Centre held pre-budget interaction with states which demanded that central government bear 50 per cent of extra expenditure on pay revision of employees.
The demand, if accepted, will further aggravate the ballooning fiscal deficit of the Union Government.
"Most of the states have started implementing their own pay revision schemes following the Government of India's decision... All the states asked, for at least one year, if the 50 per cent of the additional burden can be borne by the Central Government," VAT Panel Chairman Asim Dasgupta said.
Last year, the Centre implemented Sixth Pay Commission report which hit the exchequer by Rs 22,100 crore for 2008-09.
Talking to reporters after the meeting, Dasgupta, who is also West Bengal Finance Minister said states placed their financial problems before Mukherjee.
They also sought freedom to go for additional market borrowings to help tackle the economic slowdown even if the current limit for fiscal prudence is breached.
At present, states are allowed to raise money from market only if their fiscal deficit remains below 3.5 per cent of their state's GDP. Now, they are demanding that this limit be raised or scrapped till the economic slowdown continues.
Mukherjee, however said, "High level of fiscal deficit are not sustainable in the medium to long term, both for the states and the Centre.
