Subject: Strengthening of Vigilance set-up in Ministries/Departments- reg.
The undersigned is directed to refer to Department's Office Memorandum No. 372/19/2011-AVD-III(PU) dated 26th September, 2011 regarding strengthening of vigilance set-up in Ministries/Departments, wherein, on the basis of a recommendation made by the Group of Ministers to tackle Corruption, which was accepted by the Government, all the Ministries/Departments were advised to strengthen their vigilance administration with requisite manpower with a view to ensuring expeditious disposal of disciplinary cases. It was also advised therein to consider, where appropriate, setting up of a monitoring cell in each Ministry/Department to review and monitor the progress of all pending disciplinary cases on a day-to-day basis, with a view to ensuring their timely conclusion.
2. Further, in order to asses the work load relating to vigilance administration and the adequacy of present vigilance set-up to handle such volume of work in various Ministries/Departments to meet the challenges posed by the ever increasing volume of vigilance related work, information was called for from all Ministries/Departments vide this Department's D.O. of even number dated 17th July, 2012.
3. On the basis of an analysis of statistics received from various Ministries/Departments, the following guidelines are issued for strengthening of vigilance set up in the Ministries/Departments.
i. It should be ensured that that the Administration and Vigilance Wing are exclusively separate from each other in each Ministry/Department. Para 2.9 of vigilance manual issued by CVC indicates that participation in
decision making or close association of vigilance staff in such matters over which they might be required, at a later stage, to sit in judgment from vigilance point of view, should be avoided. Therefore, vigilance functionaries should not be a party to processing and decision-making processes or in other similar administrative transactions of such nature, which are likely to have clear vigilance sensitivity. While it may not be difficult for full-time vigilance functionaries to comply with this requirement, the compliance of these instructions could be achieved in respect of part-time vigilance functionaries by confining their duties, other than those connected with vigilance work, as far as possible, to such items of work that are either free from vigilance angle or serve as input to vigilance activities such as inspection, audit, etc. These
instructions should be adhered to strictly.
ii. Secretary of the Ministry/Department should review the pending disciplinary proceeding cases and sanction of prosecution cases each month like monitoring of VIP references/RTI cases.

V. Vide DoPT's OM No. 372/19/2011-AVD-III(Pt.1) dated 26.09.2011, all the Ministries/Departments were requested that they may, where appropriate, consider setting up of a monitoring cell to review and
monitor the progress of all pending disciplinary inquiries on a day-today basis, with a view to ensuring their timely conclusion. However, it has been observed that barring a few Ministries/Departments, such monitoring cell is yet to be set up by the Ministries/Departments. All Ministries/Departments may send an action taken report on setting up of a monitoring cell, to this department within a month from the receipt of these guidelines.
4. All the Ministries/Departments are requested to follow the above guidelines in letter and spirit to strengthen their vigilance set up.

Guidelines for monitoring and expeditious disposal of the disciplinary proceeding cases

Subject: Guidelines for monitoring and expeditious disposal of the disciplinary proceeding cases — reg.
Instructions have been issued in the past for expeditious disposal of disciplinary proceedings against delinquent government servants. However, it has been observed that disciplinary proceedings are generally taking a long time which defeats the very purpose of initiating the said proceedings. Therefore, it has been considered necessary to issue the following guidelines for monitoring and expeditious disposal of disciplinary
proceedings:-
There are a number of instances where the Courts have set aside the order of penalty due to inordinate delay in initiating action. Therefore, it has to be ensured that disciplinary proceedings are initiated without undue delay.
The Administrative Department/Competent Authority should study the allegations more carefully and resort to minor penalty proceedings instead of initiating major penalty proceedings, where the circumstances involve minor infringements or cases of procedural irregularities. It has to be kept in mind that a minor penalty swiftly but judiciously imposed by a Disciplinary Authority is much more effective than a major penalty imposed after years spent on a protracted enquiry. There is undue delay due to repeated requests of the charged officer for time to give his written statement in reply to the charge sheet. As per existing instructions, the
charged officer is allowed 10 days to submit his written statement. The charged officer may be allowed 3 — 4 days absence by the Controlling Officer for preparing his written statement in which case, no extension of time should be allowed beyond the stipulated period of 10 days. (DoP&T's OM No.142/5/2003-AVD.I dated 6th April, 2004)
iv. If vigilance angle is involved in a complaint, the case should be referred to CVC for their 1st stage advice within one month from the date of receipt of investigation report. If vigilance angle is not involved, case should be put up to the disciplinary authority for taking decision to initiate disciplinary action for major or minor penalty against delinquent officer under CCS(CCA) Rules within one month from the date of receipt of investigation report. After receipt of first stage advice of CVC, the case should be put up to the disciplinary authority for taking decision to initiate disciplinary action for major or minor penalty against delinquent officer under CCS(CCA) Rules within one month from the date of receipt of 1st stage advice of CVC.
xii. After the receipt of the representation of charged officer on Inquiry Report, the case may be sent to CVC, wherever required, for their second stage advice, or to UPSC for their advice, as the case may be, within one month. (CVC's Circular No 00ONGL/18 dated 231-d May, 2000)
xiii. Penalty order should be issued within a month from the date of advice of UPSC. (DoP&T's DO No 134/2/83-AVD.I dated 2nd May, 1985)

xv. Each Ministry/Department may keep ready a panel of 10/P0 from their retired government officers which may ,be used when no serving government servant is available for appointment of IO/PO. The services of I0s/POs who would be available on the panel maintained by CVC may also be utilized in consultation with CVC.
All the Ministries/Departments are requested to follow the above guidelines in letter and spirit so that disciplinary proceedings are concluded expeditiously.

The undersigned is directed to refer to this Department's O.M. No.21012/4/88- Estt.(Allowances) dated 22nd August, 1988, on the captioned subject and to state that in partial modification of the aforesaid O.M., the President is pleased to revise the rates of Risk Allowance in respect of the existing categories of Central Government employees with effect from 1 st September, 2008, as under:
1. Unskilled workers 40.00
2. Semi-skilled workers 60.00
3. Skilled workers 80.00
4. Supervisors 100.00
5. Non-gazetted officers engaged in Nitro Glycerine preparation 180.00

2. The amount of Risk Allowance would be automatically raised by 25% every time the Dearness Allowance on the revised pay structure goes up by 50%. No separate instructions on this count would be required.
3. All other terms and conditions envisaged in the O.M. dated 22.08.1988 shall continue to apply.

Subject: Payment of Dearness Allowance to central Government employees – Revised rates effective from 1.1.2012.
The undersigned is directed to refer to this Ministry’s Office memorandum NO. 1(14)/2011-E-II(B) dated 3rd october , 2011 on the subject mentioned above and to say that the president is pleased to decided that the Dearness Allowance payable to Central Government employees shall be enhanced from the existing rate of 58% to 65% with effect from 1st January, 2012.
2. The provisions contained in paras 3, 4 and 5 of this Ministry’s O.M. No. 1(3)/2008-E-II(B) dated 29th august, 2008 shall continue to be applicable while regulating Dearness Allowance under these orders.
3 The additional installment of Dearness Allowance payable under these orders shall be paid in cash to all central government employees.
4 These orders shall also apply to the civilian employees paid from the Defence Services estimates and the expenditure will be chareable to the relevant head of the Defence services estimates. In regard to Armed Forces peronnel and Railway employees separate orders will be issued by the Ministry of Defence and Ministry of Railways respetviely.
5 In so far as the persons serving in the Indian Audi and Accounts Department are concerned, these orders issue in consultation with the comptroller and Auditor General of India.

This department has been receiving references regarding revision of Special Allowance and Cash Handling Allowance subsequent to increase in the rate of DA @ 51% w.e.f 1.1.2011.
This department’s O.M. No. 4/6/2008-Estt.(Pay II) dated 1st October, 2008 states that the rates of Special Allowance and Cash Handling Allowance will be automatically increased by 25% every time the Dearness Allowance payable on revised pay scales goes up by 50%.

DoPT Circular regarding Study Leave for Fellowships
The feasibility of bringing more Fellowships under the purview of Study Leave, on the same terms and conditions as the Jawaharlal Nehru Memorial Fellowships (.INMF) has been under consideration of' this Department for some time. On the basis of the inputs from various Departments/Ministries regarding fellowships offered by reputed institutions and in consultation with Department of Expenditure, it has been decided to include the Fellowships offered by
(i) K.K. Birla Foundation,
(ii) Indian Institutes of Management,
(iii) Management Development Institute. Gurgaon and
(iv) Fok Nayak Jayaprakash Narayan National Institute of Criminology Sc. Forensic Science on the same terms as that of the fellowship offered by JNMF at present. The following terms will be offered to Central Government employees who are awarded the said fellowship in relaxation of Rule 51, 57 and 59 of Central Civil Services (Leave) Rules, 1972 :-
i) They will be granted study leave for the entire period of the Fellowship;
ii) They will be entitled to the benefits admissible to them in accordance with the Fellowship and in addition, entitled to draw leave salary only (without allowance) equal to the pay that they drew while on duty with the Government immediately before proceeding on such leave. However, they will be entitled to Dearness Allowance at the Central Government rates on the leave salary admissible to them;
ii) Where considered necessary, the official may be allowed during the
period of the Fellowship, the continued use of the facility of the residential telephone officially allotted to him, subject to payment by him of the bills for the rental and call charges of the telephone. 2. So far as persons serving in the Indian Audit & Accounts Departments are concerned, these orders are being issued after consultation with the C&AG of India.
3. This order takes effect from the date of issue.

This Department in OM No.AB1401716112008-Estt(RR) dated 24.3.2009 issued the guidelines for amendment of Service Rules/Recruitment Rules for incorporating the changes arising out of 6th CPC recommendations. Separately the revised eligibility conditions for SAG & HAG level for members of Organized Group A Services have been issued in this Department OMS dated 15.12.09 (Non-Technical) and 18.01.201 1 (Engineering Services). The provisions with regard to grant of functional scale of Rs. 14300-18300 (pre-revised) to the SEs and equivalent in respect of Engineering Services prescribed in OM dated 29.12.2010 also refers. Instructions for grant of NFU as per 6'h CPC recommendations have been issued in OM dated 24.4.09
2. As the Recruitment Rules/Service Rules are required to be amended after incorporating the above instructions, all the ministries / Departments / Cadre Controlling Authorities of Organized Group 'A' Services may take immediate necessary action for notification of Service Rules positively by 31.3.2012 in consultation with DOPTIUPSC 8 Ministry of Law.

Children Education allowance Clarification:
The undersigned is directed to refer to DOP&T O.M. No. 1201 1 /03/2008- Estt(Al1owance) dated 02-09-2008 and clarificatory OM No.12011/16/2009- Estt.(AL) dated 13.1 1.2009 on the Children Education Allowance(CEA) Scheme, this Department has been receiving references from various Departments seeking firther clarifications. The doubts raised are clarified as under:-
Q1. Whether children education allowance would be admissible beyond two children due to failure of sterilization operation ?
Ans1: The reimbursement of children education allowance is admissible only for the first child born after failure of sterilization operation.
Q2: Whether the admissible amount per annum per child (annual ceiling of Rs 15000/-) on account of CEA can be reimbursed in full in the first quarter of the financial / academic year itself ?
Ans2: It is clarified that a government servant is allowed to get 50% of the total amount subject to the overall annual ceiling in the first quarter and the remaining amount in the third and or fourth quarter. Frontloading of the entire amount in the first and the second quarter is not allowed.
(ii) A government servant can claim full amount subject to the annual ceiling of Rs 15000/- in the last quarter.

It has been decided that the holidays as specified in the Annexure -I to this O.M. will be observed in all the Administrative Offices of the Central Government located at Delhi/New Delhi during the year 2012. In addition, each employee will also be allowed to avail himselfJherself of any two holidays to be chosen by him/her out of the list of Restricted Holidays in Annexure - 11.

3.1. The final list applicable uniformly to all Central Government offices within the concerned State shall be notified after seeking prior approval of this Ministry and no change can be carried out thereafter. It is also clarified that no change is permissible in regard to festivals and dates as indicated.

3.2 No substitute holiday should be allowed if any of the festival holidays initiallly declared subsequently happens to fall on a weekly off or any other nonworking by or in the event of more than one festivals falling on the same day.
4. The list of Restricted Holidays appended to this O.M. is meant for Central Government Offices located in Delhi / New Delhi. The Coordination Committees at the State Capitals may draw up separate list of Restricted Holidays keeping in view the occasions of local importance but the 9 occasions left over, after choosing the 3 variable holidays in para 3.1 above, are to be included in the list of restricted
holidays.
5.1 For offices in Delhi / New Delhi, any change in the date of holidays in
respect of Idul Fitr, Idul Zuha, Muharram and Id-e-Milad, if necessary, depending upon sighting of the Moon, would be declared by the Ministry of Personnel, Public Grievances and Pensions after ascertaining the position from the Govt. of NCT of Delhi.
5.2 For offices outside Delhi / New Delhi, the Central Government Employees Welfare Coordination Committees at the State Capitals are authorised to change the date of holiday, if necessary, based on the decision of the concerned State Governments / Union Territories, in respect of Idul Fitr, Idul Zuha, Muharram and Id-e-Milad.
5.3 It may happen that the change of date of the above occasions has to be declared at a very short notice. In such a situation, announcement could be made through T.V. / A.I.R. / Newspapers and the Heads of Department / Offices of the Central Government may take action according to such an announcement without waiting for a formal order, about the change of date.
6. During 2012, Diwali (Deepavali) falls on Tuesday, November 13, 2012
(Kartika 22). In certain States, the practice is to celebrate the occasion a day in advance, i.e., on "Narakachaturdasi Day". In view of this, there is no objection if holiday on account of Deepavali is observed on "Naraka Chaturdasi Day (in place of Deepavali Day) for the Central Government Offices,in a State if in that State that day alone is declared as a compulsory holiday for Diwali for the offices of the State Government.
7. Central Government Organisations which include industrial, commercial and trading establishments would observe upto 16 holidays in a year including three national holidays viz. Republic Day, Independence Day and Mahatma Gandhi's birthday, as compulsory holidays. The remaining holidays / occasions may be determined by such establishments / organisations themselves for the year 2012. subject to para 3.2 above.
8. Union Territory Administrations shall decide the list of holidays in terms of Ministry of Home Affairs letter No.14046/27/83- GP-I dated 15.2.1984 by which they would observe a total of 16 holidays including the three National Holidays Vi. Republic Day, Indep-e ndence Day & Mahatma Gandhi's birthday. –.
9. In respect of Indian Missions abroad, the number of holidays may be

In other words, they will have the option to select 10!Ten) holidays of their own only after including in the iist, three National Holidays md Milad-un-Nabi or Id-E-Milad, Buddha Purnima, Idul Zuha (Bakrid) and Muharrarn included in the hst of compulsory holidays and falling on days of weekly off.
10. In respect of Banks, the holidays shall be regulated in terms of the extant instructions issued by the Department of Financial Services, Ministry of Finance.

Subject : Encashment of Leave to be granted to Government Servants on
their appointment in Central Public Enterprises
The undersigned is directed to state that this Department has been receiving references from various Ministries / Departments seeking clarification regarding the entitlement to leave encashment on appointment of Government Servants in Central Public Enterprises.
2. As per DoPT OM No. 2801615/85-Estt.(C) dated 3 1/1/1986, appointment of an officer in a Central Public Enterprise after acceptance of his technical resignation from Government is treated as immediate
absorption. As per the terms and conditions contained in this OM, a Central Government Servant taking appointment in the Central Public Enterprises on Immediate Absorption basis was entitled to encashment of Earned Leave to his credit at the time of acceptance of his resignation from Government Service, subject to a limit of 180 days. Half Pay Leave stood forfeited. (The limit of Earned Leave which could be thus encashed was later raised to 300 days).
3. It is clarified that as per rule 39-D of the CCS (Leave) Rules, 1972, the calculation of leave encashment in case of permanent absorption in Public Sector Undertaking / Autonomous Body wholly or substantially owned or controlled by the Central / State Government will be as per mlc 39(2)(b) which has been amended vide Notification GSR 170 dated 1/12/2009 to read as under:-
The cash equivalent of leave salary under Clause (a) shall be calculated as follows and shall be payable in one lump sum as a onetime settlement

Subject: Conclusion of Special Recruitment Drive launched for filling up the backlog reserved vacancies of Persons with Disabilities.
The undersigned is directed to refer to this Department's OM of even
number dated 27.1 1.2009 whereby a Special Recruitment Drive for filling up the backlog reserved vacancies of SCs, STs and OBCs was launched. It was stipulated that all the backlog vacancies existing in the Ministries / Departments and its Attached Offices / Subordinate Offices / Public Sector Undertakings / Autonomous Bodies etc. as on 1 5.1 1.2009 shall be filled up by 15.7.2010. It could, however, not happen. The Drive was, therefore, extended upto 3oth June 201 1 vide OM of even no. dated 04.0 1.20 1 1 and all the Ministries / departments were requested to make concerted efforts to fill up the backlog reserved vacancies which had remained unfilled till then during the extended period of the Drive.
2. In view of the fact that the drive would conclude on 30.06.2011, it is requested that earnest efforts be made to fill up all the identified backlog vacancies by the said date.
3. All Ministries / Departments are requested to submit the progress of the drive to this Department, in preformed already prescribed earlier, in respect of the Ministry / Department and all its attached subordinate offices and autonomouslpublic sector undertakings by 20.07.2011.
4. It may be noted that progress of the drive is to be submitted to the
Cabinet immediately on completion of the drive and as such it would be important that complete and up to date information is sent to this Department by the above date so that correct progress may be reported to the Cabinet, for which Ministry / Department would be responsible.

Subject:- Departmental proceedings against Government servants - consultation with the Union Public Service Commission for advice.
The undersigned is directed to say that this Department has been impressing upon various Ministries / Departments to complete the disciplinary proceedings by minimizing avoidable delays. In para 3.11.10 of the 4th report of the 2nd ARC titled "Ethics in governance", it has been observed from a sample study that the Administrative Departments take more than 2/3rd of the time taken to process the case under the CCS(CCA) Rules. In the sample study, the Inquiry Officers were found to be taking about 17% of the time and the UPSC about 5% of the time to conclude their findings. This Department has issued OM No.3901111212009-Estt.(B) dated 14.9.2010 reiterating that the requisite details in the proforma to be sent to the UPSC are properly filled up and sent with the relevant documents so that there does not arise occasion for the UPSC to make a back reference to the Ministries / Departments for the deficiencies found by the Commission in the papers sent to them.
2. The UPSC has brought to the notice of this Department that during the year 2010-11 the Commission had to return the case to the concerned Departments in more than 40% of the cases on account of procedural / documentary deficiencies. A list of the common deficiencies observed by the Commission in these cases are / given. in the Annexure. All Ministries / Departments are requested to ensure that the deficiencies indicated in the Annexure are not repeated in the proposals being sent to the UPSC for seeking its advice on disciplinary matters.
3. Attention of Ministries / Departments is also drawn to this Department's OM No.3901111212009-Estt.(B) dated 16.11.2010 wherein it has been requested that in cases where the Courts are being apprised of the time taken in finalizing a disciplinary proceeding through affidavit, information in regard to the pendency of the matter before the UPSC may be correctly projected. The average time taken by the Commission in tendering advice in disciplinary proceedings is about 4 to 6 months. The Commission tender its advice in about 3 months in those cases where priority is attached due to direction of Court. In such cases, in order to sypedite scrutiny of the cases a single window system on pilot basis had been introduced in the UPSC from September 2010 and initially 9 Ministries / Departments were included in the single window system. The Commission has now decided to extend the single window system to all other Ministries / Departments whose offices are situated in Delhi for submission of disciplinary cases involving court cases. Under this system, a Ministry / Department while referring the disciplinary cases to the Commission for advice, is required to authorize a representative, not below the level of Under Secretary, to hand over the case to the designated officer in the UPSC, with prior appointment. The cases received from a Ministry / Department are initially scrutinized on the spot, in terms of information sought in the Proforma check list issued by this Department. Only cases which are complete as per the check list are
accepted by the Commission for further scrutiny and examination. Incomplete cases are returned at the counter itself after pointing out the deficiencies. In UPSC, the case records are to be handed over to the Under Secretary (S-1),(Tel No.23387346123098591-Ext.4342) in Room No.10-A located in the Annexure Building of the Commission. The case records should explicitly indicate the status of the CATICourt cases, the fact regarding the time limit for disposal of the case if any and extension sought for providing at least 3-4 months of time to the Commission for
disposal of the case.
4. All Ministries / Departments are requested to adhere to the above procedure for submission of disciplinary cases involving Court cases to the Commission through single window system.

However, it can also be granted for studies which may not be closely or directly connected with the work of a Government servant , but which are capable of widening his mind in a manner likely to improve his abilities as a civil servant and to equip him better to collaborate with those employed in other branches of the public service. Keeping in view the above spirit, this Department had allowed study leave to those selected for the award of Jawaharlal Nehru Fellowship in relaxation of the rules.

The undersigned is directed to refer to this Department’s O.M of even Number dated 18th November, 2010 on the above subject and to say that feed back on fellowships offered by reputed institutions which may be of benefit to their area of work is still awaited from various Ministries. Study leave is normally granted to a government servant for a course of study having direct and close connection with the sphere of his duty. This Department is examining the feasibility of bringing more fellowships under the purview of study leave, on the same terms and conditions as the Jawaharlal Nehru Fellowships. All Ministries / Department are requested to provide relevant/ requisite inputs regarding fellowships offered by reputed institutions which may be of benefit to their area of work. It would be appreciated if the feed back is received by the undersigned by 20th may, 2011. The same may be mailed to the under signed as pads@nic.in. Subject: Clarification on increase in certain allowances by 25% as a result of enhancement of Dearness Allowances w.e.f. 1.1.2011 -
On the above mentioned subject, it is stated that consequent upon enhancement of Dearness Allowance payable to Central Government employees @ 51% w.e.f. 1st January, 2011 vide Ministry of Finance, Department of Expenditure O.M. No.1(2)/2011-E-I1 (l3) dated 24 th March, 2011, the following points are clarified:
a) The annual ceiling limit for reimbursement of Children Education Allowance shall be Rs.15,000/- per child. Accordingly, the quarterly claim could be more than Rs.3750/- in one quarter and less than Rs.3750/- in another quarter subject to the annual ceiling of Rs.15,000/- per child and Hostel Subsidy shall be Rs.3750/- per month per child;
b) The rates of Special Allowance for Child Care to women with disabilities stands revised to Rs. 1250/- per month; and
c) The annual ceiling for reimbursement of education allowance for disabled children of Government employees shall be treated as revised to Rs.30,000/ per annum per child and the rates of Hostel Subsidy for disabled children of Government employees shall be treated as revised from Rs.6000/- per child per month to Rs.7500/- per child per month.
2. These revisions are applicable with effect from 1st January, 2011
3 . These revisions shall be subject to other terms and conditions mentioned in this Department's O.M. No.12011/03/2008-Estt (Allowance) dated 2.9.2008 and O.M. No 12011/04/2008 dated 11.9.2008.

SUMMARY RECORD OF DISCUSSIONS HELD DURING THE THIRD MEETING OF THE JOINT COMMITEE ON MACPS HELD UNDER THE CHAIRPERSONSHIP OF THE JOINT SECRETARY (ESTABLISHMENT), DOP&T ON 15TH MARCH 2011
The third meeting of the Joint Committee constituted to examine the anomalies pertaining to the MACP scheme was held under the Chairmanship of Joint Secretary (Estt.) Department of Personnel & Training on 15Ih arch, 201 1. All the members of the Committee were present in the meeting.
2. The Chairperson welcomed the representatives of the Official Side and the Staff Side and .stated that with respedte item numbers 13, 21, 27, 28, 32, 38, 44, 50 & 58, suitable instructions had been hued vide this Department's O.M. dated the 1'' November, 2010. She also informed that as per the decision taken in the second meeting of the Joint Committee, vide this Department's O.M. dated Both ! February, 2011, all concerned have been advised to review the cadre structure in a tlme bound manner with a view to mitigate the problem of stagnation I 3. Thereafter, the agenda items which were still pending were taken up for discussion.
Item numbers 1.3.8. 9 & 29- Grant of financial up-gradation in the promotional hierarchy instead of Grade Pay hierarchy under the MACPS.
The Staff Side reiterated their demand that the financial upgradations under the MACP Scheme should be granted in the promotional hierarchy of posts instead of the Grade Pay hierarchy. The Staff Side stated that the erstwhile ACP Scheme was implemented on the recommendations of the 5Ih CPC and, as such, has become a part of the service conditions of the employees. The Staff Side, therefore, contended that the Government cannot impose the MACP Scheme thereby altering the service conditions to the detriment of the employees.
The Official Side stated that the 6'h CPC recommended two financial
upgradations in the Grade Pay hierarchy after 12 and 24 years. However, the Government improved upon the recommendations of the 6th CPC and has implemented MACPS with three financial upgradations in the Grade pay hierarchy after 10, 20 & 30 years. Referring to earlier discussions held in the matter, the Official Side stated that the Government was willing to consider revision in para 13 of the MACP Scheme to the effect that organisations I cadres shall have the option (r,--tk MAGP Scheme. However, the Staff Side pointed that such a dispensation will not be practical and hence there is a need to explore other alternatives to solve the issue. After discussion, it was agreed that there is no need to change the basic structure of MACP Scheme. However, there is a need to separately examine those cases where MACP Scheme is less advantageous than the ACP Scheme. Accordingly, it was decided that the Official Side will write to the Ministry of Railways, Defence, Urban Development, Home and the Department of Posts to forward information in respect of the specific categories of employees where the MACPS is less advantageous than the erstwhile ACP Scheme The Official Side also requested the Staff Side to collect and forward such information to the Department of Personnel 8 Training for further necessary action.
In this connection, the Staff Side specifically pointed out the case of Technician category wherein under ACP (w.e.f 1.10.199) the staff got upgradation to Rs.4500- 7000 (V CPC) on completion of 24 years whereas under MACPS they get the same benefit, i.e. Grade Pay of Rs.2800 afler 30 years.
Item Nos. 2,7,20 8 48- Date of Effect of MACP Scheme
The Staff Side stated that many employees who retired between 1.1.2006 and 31st August, 2008, have been deprived of the benefits of MACP Scheme and therefore, demanded that the MACP Scheme may be made effective from 1.1.2006. The Official Side stated that the matter was discussed and finalised in the second meeting of the Joint Committee and therefore, there was no reason to reopen the matter. After discussions, it was decided that the matter may be treated as finalised so far as the Joint Committee on MACP IS concerned and if required, the Staff Side may raise this issue in the next meeting of the National Anomaly Committee.
Item Nos.57-Grant of ACP benefit to Artisan Staff of the Ministry of Defence
The Staff Side stated that consequent upon the recommendations of the Fast Track Committee, the highly skilled Artisan Staff of the Ministry of Defence was bifurcated in two categories, i.e., Highly Skilled -11 (with Grade Pay of Rs.24001-) and Highly -Skilled-l (With Grade Pay of Rs.28001-). The Staff Side contended that this bifurcation, in the first instance, may be treated as placement and not as promotion for the purpose of MACP. The Official Side stated that as per the extant instructions of the Department of Personnel 8 Training, where the whole of a cadre is placed in a higher scale, such placement is not treated as promotion. However, when only a part of a cadre is placed in a higher scale, then such placement is treated as promotion for all purposes including MACPS. The Official Side further stated that even under the erstwhile ACP Scheme similar practice was followed and there is no
reason to deviate from that.
The Staff Side cited a Supreme Court judgment in the case of Union of India Vs V.K. Sirotia reported in 1999 Supreme Court cases (L&S) 938 that where certain percentage of post are granted higher pay scales to seniors in the cadre will be treatedas placement and not promotion. The Staff Side also cited the Manual of instructions for restructuring of cadres in 1.A & A.D (para 3.2.8) wherein it has been stated that the Screening Committee in combined Audit & Accounts Offices besides selecting persons for transfer to audit offices will also decide on their placement ( & not promotion) against the higher scale posts. After prolonged discussions, it was decided that the matter would be reexamined
by the Department of Personnel & Training in consultation with the
Department of Expenditure.
Item Nos. 12, 30 & 49 - Treatment of employees selected under LDCE Scheme / GDCE Scheme.
The Staff Side demanded that employees selected under the LDCE Scheme1 GDCE Scheme should be treated as a direct recruit and their earlier promotions and services rendered should be ignored for the purpose of MACPS as was being done in the ACP Scheme. T-h-e Official - Side informed that treatment of such cases would generdly be same in MACP as was in the ACP Scheme. Ministry of Railways would be advised to examine the matter accordingly.

Promotion in the identical Grade Pay The Staff Side raised the issue of promotions in the identical grade pay and demanded that in such cases the benefit of one increment should be granted at the time of promotion. 'The Official Side stated that if regular promotion is to the same grade pay, then MACP would also be granted to the same grade pay. On the issue of whether one increment is to be allowed in such cases, a reference has been received in the Department of Expenditure from Ministry of Railways. Further action in the matter would be taken consequent upon receipt of certain information from Ministry of Railways as called for by the Department of Expenditure.
4. . After discussion on the agenda items, the Staff Side stated that in many instances the provisions of the MACP Scheme were being misinterpreted by various Ministriesl Departments thereby causing financial loss to the employees. The Official Side stated that many Ministries / Departments had sought various clarifications regarding the provisions of the MACP Scheme which has been given.
In addition, many clarificatory Office Memoranda have also been issued by the Department of Personnel & Training to allay the misgivings misunderstandings regarding the Scheme. However, if certain misgivingsl misunderstandings were still continuing, the respective Ministriesl Departments may be advised to refer the matter to the Department of Personnel & Training for resolution of the same.
5. In the end, it was decided that the recommendations of the Joint Committee on MACP Scheme along with the action taken report may be discussed in the next - meeting of the National Anomaly Committee.
6. The meeting ended with a vote of thanks to the Chair.
