Introduction:

Swamy’s handbook is one of the most useful resource for central government servants in the form of printed books. The latest edition is Swamy’s Handbook 2010. It incorporates all the latest orders based on Sixth Pay commission recommendations.

 

Swamy’s Handbook is an easy access to Regulations, codes and manuals. Its a brief essence  of the relevent rules or orders. The first Handbook was published on 1975.

  2. Sir, There is a clarification required by you sir
    basically I am Telephone Supervisor in Naval Base
    and the cadre is existing of Time Bound Promotion of 16 yrs and 26 yrs and on completion of 16 years the pay scale was granted to me was 5000-150-8000(19-7-1998 ) and subsequently i was granted 2 nd Time bound promotion and pay scale of 5500-175-9000 was granted to wef 19-7-2008. But when I was granted 6 th cpc pay scale I got 9300-38000 with a grade pay of Rs 4200/ and the promotional pay for 5500-175-900 was not given by an additional increment or a higher grade pay of 4600/- and recently the Government issued orders for merging of 5000-150-800 and 5500-175-900 for which a irreparable loss for me for not getting a promotional /financial loss. In this connection the administration is confirming that 3% of increment is not feasible in same grade pay. in this context I required your interference to resolve the problem, by giving a valuable suggestion.

    I need your help by solving my quiery.
    I am a central govt permanent staff working in Kolkata. I went to my native chennai on emergency leave from 6th sept. to 17th nov to take care of my mother who suffered a heart attack.now I came back to join on 18th. Nov. I ve 20days EL & the rest will be LND.My office is asking for my mother's
    medical records to sanction my leave or else they will consider my leave as EOL without pay i.e a service cut. I dont want to expose my mother's medical records to my office.kindly suggest me with solution. thanks.

  6. I am computer assistant in CG organization. While working as Jr Asst. I got selection as Data Entry Operator and had difference revision of scales. I have 28 yrs of service which includes Jr. asst. 4yrs 4 months, Data entry operator 15 yrs 7 months, Computer assistant 8yrs 3 months. I am MCA with additional PGDCA from IHRDE. My friend James joined as Jr assistant along with me. He became Jr. Asst. Gr I and then Assistant . Now He is getting 6500-10500 scale under MACPS. My scale is 5500-9000 only and no scope for promotion. Am I eligible for the scale 6500-10500 under MACPS.

Government of India, Ministry of Personnel vide OM No.31011/2/2006-Estt.(A) dated 11th March, 2010 issued an order clarifying that restriction of travel by Air India only need not apply to non-entitled Central Government Officers who tavel by air and claim LTC reimbursement by entitled class of rail.

    Again the Government of India, Ministry of Finance vide its OM No.19024/1/2009-E.IV dated 16-9-2010 issued guidelines on Air Travel on LTC in which it has clarified that (i)One should travel by Air India only (ii) In economy class only, irrespective of entitlement (iii) Air Tickets may be purchased directly from Airlines etc.

    Now since the orders of two Ministries are different, I would request you to clarify whether the Ministry of Finance's order will override the order of Ministry of Personnel?

    I was appointed as jr Hindi translater 16/04/1993 in the office of Dy.C.L.C (C)and after completion of 12 years of service , I was granted A.C.P on April 2005 in the scale of 5500-9000 .In accordance with recommendations of sixth pay Commission, The M.O.F vide O.M.NO. F.NO. 1/1/2008-IC Dt . 24.11/2009 has upgaded the scales.According to A.C.P scheme. I should have been granted pay scale of 7450-11500 in Grade pay of 4600 which many Central govt offices are giving to their employees but my deptt has denied me the benifit and I have been granted M.A.C.P w.e.f 01.09.2008 in the grade pay of 4600.Kindly give the correct position as on 01.01.2006 A.C.P scheme was oprational.

I want to make my Indian Passport.So I applied to our office to give me Annexure B (a Identity Certificate) in the performa issued by Ministry of External affairs, CPC div, New Delhi. My office issued me NOC but not in performa stated by Ministry of Externel Affairs. So when I applied to passport office, they said that NOC is not in proper format so plz u again take it from the office and persue again with the same file.
    I again applied to re-issue Annexure B in proper format.But our office personnel said that he can not give in proper format.
    I paste this format and kindly help me what can I do. I think this format does not says anything wrong for which office can not issue it.

  22. I joined here ,after technical resignation from my parent organisation. Only thing I joined here on zero seniority.Now I am the senior most in my cadre.Whether I am eligible for promotion? I have 20 years of service and I got 2 macp also.Iam now working as Chargeman-II.Chargeman-I,Asst foreman,Foreman are the next higher posts. Now Chargeman I and Chargeman II are merged. Asst foreman and Foreman are also merged. I am qualified for Asst foreman.Whether I have to qualify for Foreman now? Is there any time period for qualifying test for Foreman for me?

    I am post graduate/FACULTY/CG aided COLLEGE drawing salary lesser to my colleagues by a margin of one increment after implementation of 6th cpc in our institutuion compared to my colleagues who did their PG after joining.Joining dates of all of us are same and lies in same group A cadre but still those who did their PG are drawing salary greater @3% basic.As per 6th cpc we ought to have same increments.Please do suggest me the rule or the reference so that the rightful claim can be cashed.Please write to me at ami_sunny@yahoo.co.in

    I joined as L.D.C. on 10/09/1987 on regular basis and was promoted as U.D.C. (Ad-hoc) in 1990. Then I joined the other deptt. as L.D.C. (Hindi Typist) on 08/09/1993 after seeking revertion on transfer basis on my own request (inter deptt./ministry transfer). Then I was selected /appointed as Jr.Hindi Translator (on-deputation basis) in the same deptt. as direct selection through Advertisement and joined the same post on 07/04/1997. I remained on deputation from 07/04/1997 to 01/11/2000. I was absorbed permanently to the post of Jr.Hindi Translator on 2nd Nov.,2000. I served the previous deptt. from 10/09/1987 to 07/09/1993.
    It is stated that no ACP/MACP has been granted to me after serving both the deptts. for about 23 years. Now I am drawing a grade pay of Rs.4200 in the Pay Band of Rs.9300-34800 as per Sixth CPC.
    Kindly let me know how many ACP/MACP are due to me and what grade pay has been granted to Jr. Hindi Translators by the Govt. at present? Please write me at adarshnannu@gmail.com

    I am jr. hindi translator. my pre-revised pay scale was rs.5000-8000 and i was drawing rs.6200 as on 1.1.2006. now i have been allocated revised pay scale of rs.6500-10500 in revised pay band of rs.9300-34800 w.e.f. 1.1.2006. my revised grade pay is the same i.e rs.4200 .the fixation and drawal of pay in the revised structure shall be as per provisions contained in CCS (RP) Rules, 2008 vide GSR 622 (E) dated 29.08.2008.
    Where my pay should be fixed in the revised pay scale of rs.6500-10500 as on 1.1.2006.Will there be any change in my fixation? Please write me at adarshnannu@gmail.com

    I joined the income tax department as DEO Gr B in the year 1989. Being a technical staff we have not allowed to give Departmental Examination. Later in the year 1999-2000 we (DEO’s) were allowed to give exams. I cleared UDC in 2000. After that in the year 2002 i appeared for Inspectors exam , but after declaration of result I was told that you were not eligible for exam. After that up to 2006 i was not allowed to give exam and then in the year 2007 i cleared Inspectors Exam. Now at the time of DPC the year of passing the exam is one of the criteria. At the time of restructuring i was DEO gr B with 14 years continuous service and departmental exam of UDC cleared I should have re-designated as Office Superintendent but I was in the post of DEO gr B till DEC 2004 and on 24/12/2004 I was re designated as Sr. T.A. and not as Office Superintendent. I had loss my seniority at the time of restructuring too. please Advice.

    i am a crpf employee posted at Gujarat and was sent for imparting training to various police personnel at crpf training centre and remained there for five years getting TA only for first six months and after that no any monetary allowance was given to me except pay.Two questions i haveto clarify is
    1.Whether i am eligible for any allowance for the period i spent fo imparting training as an instructor.
    2. Transport allowance which was given during the said period is being recovered saying that transport allowance is not entitled for attachment period and i was not using Government vehicle during that period and department has detailed me for the said training.

    A. No HRA was given during training,
    B. License fee @ Rs.84/- per month per trainee was deducted for one room i.e. 84 * 3 = Rs.252/-
    C. A maintenance charge of Rs. 50/- per day per trainee was also deducted for one room i.e. 50*30*3=Rs.4,500/- approx per month.

    (i) Some trainees were enjoying dual benefit, they were using Govt accommodation allotted by previous Department as well as the hostel facility at ISTM.
    (ii) One of the trainees was exempted from staying in hostel and she was allowed to have HRA.
    (iii) Previously DoPT had the practice that the trainees were joined the Department/Ministry directly and sent to ISTM in a phased manner thus there was no question regarding HRA during training.

    I have commuted an amount of Rs.376/- at the time of retirement which is to be restored from 01-7-2011. After the implementation of V Pay Commission two more installments of amounts i.e. Rs.914/- from 23-1-1996 and Rs.94/- from 12-6-2000 have been commuted. It is understood that as per the Govt. of India’s decision these two installments of commutation may also have to be restored along with the first installment of commuted amount irrespective of their payments. In this regard u may please clarify along with the necessary instructions on restoration of installments of II and IIIrd installments.

    1.Most respectfully, I have the honour to state the following few lines for your kind consideration and favourable order please.
    2.I was drawing a basic pay of Rs. 5850/- on 01-01-2006 in the pre-revised scale of Rs. 5500-175-9000. Being Hindi Teacher (Graduate), I was granted the revised Pay Band of Rs. 9300-34800/- with Grade Pay of Rs. 4600/- as per Gazette of India Extraordinary [Part II-Sec 3(i)], Page No. 47, SL No. XVII, Teachers.
    3.My revised pay in the Pay Band of Rs. 9300-34800/- with grade Pay of Rs. 4600 had been fixed at Rs. 10890+4600/- total Rs. 15490/- as on 01-01-2006.
    4.But as per the Gazette of India Extraordinary [Part II-Sec 3(i)], Page No. 43 and Swamynews dated Feb 2009, Page No 97, Serial No. 3 of Readers Forum, the entry pay in the revised pay structure for direct recruits appointed on or after 01.01.2006 in Pay Band of Rs. 9300-34800+4600/- (Grade Pay) should be Rs. 12,540/- + 4600/- (Grade Pay) i.e. Rs. 17,140/- (Copy att).
    5.Thus, I am drawing less pay i.e. Rs. 10,890+4600/- (Grade Pay) i.e. Rs. 15,490/- than new recruits as on 01-01-2006.
    6.But, as per clarification of Delhi Educationist For Legal And Teaching Assistance, my Pay in the Pay Band of Rs. 9300-34800/- with Grade Pay of Rs. 4600/- should be fixed at Rs. 12920+4600/- i.e. Rs. 17,520/- as on 01-01-2006 (Copy att).

    I am a Steno Gr II (Grade Pay Rs.4200) working in Central Government office at Mumbai. I joined the office as an LDC and was promoted as Steno Gr III in the pre-revised scale Rs.4000-6000 in April 2000. Thereafter my pay was fixed as per 6th Pay Commission in PB-I with a Grade pay of Rs.2400/-.After completion of 8 years of service in the post of Steno Gr III, i was promoted to the post of Steno Gr. II on 1st January, 2009 and was placed in PB-2 and granted with a Grade pay of Rs.4200/-. On 1st January, 2011, i am eligible for the promotion to the post of Grade I steno but still awaiting the promotion due to the non-amendment of the old Recruitment rules in my office. Meanwhile, DOPT on 10th March, 2010 vide OM No.AB-14017/8/2010-Estt(RR) has redesignated Steno Gr III to Steno GR II. They have not clarified about the Grade Pay that would be drawn by both the Grades. Could u please clarify the following-
    i) what would be the grade pay of Steno GrII and Grade III at present.
    ii) If Steno grade III and Gr II would be drawing the Grade pay of Rs.2400 in PB-1, then what will happen in my case, as i have already promoted to Gr II and been granted the Grade pay of Rs.4200/- in PB-2.
    iii)Can my promotion to the post of Stenogapher GrI be done without amending the existing RRs?

  52. Sir since you are well versed with the govt. rules and and its way of functioning.I want you advice on the following case:
    Kendriya vidyalaya sangathan is a autonomous body of central govt. under ministry of HRD.
    Now what has happened is that the board of governors have approved the implementation of macp for its employees.
    But the HRD ministry has approved the implementation of MACP for non teaching staff i.e. from the commissioner of kvs to the lower divisional clerk but have rejected macp for teachers and principal of kvs schools on the plea that earlier ACP was not implemented for teachers.

    MY QUESTION IS THAT IF THE HIGHEST AUTHORITY THE BOARD OF GOVERNORS HAVE APPROVED THE IMPLEMENTATION OF MACP FOR ITS ENTIRE STAFF WITHOUT DISTINGUISHING BETWEEN TEACHING AND NON TEACHING THEN WHY THE HRD OFFICIALS ARE NOT ALLOWING MACP FOR TEACHERS.
    Also if a institution has due to some reason not implemented ACP for its teaching staff earlier and now wants to bring parity among all its employees then can it not do so by approving the implementation of MACP for all its employees.

    I am working as teacher in kendiya Viddyalaya Sangathan, I was trasferred in public interest during my summer vacation. I was relieved in absentia by post dated 20.6.2011. On the date and till end of Summer vacation ( ie. 27.6.11) I was out of station with permission ( Satation Leave granted).

    when I came to know, I reached my KV and handover charges and collect relieving order on 27.6.11. The date of Relieving order was 20.6.2011. I moved immediately on 28.6.11, made journey continously and joined new place of posting on 30.6.11 forenoon.

    The distance between two station is about 1800 km. I have applied for joining time (transit leave) for 12+3 days. But our office told me that the period of joining time will be counted from the date of relieving order (20.6.11)and the period of 9 day (21.6.11 to 29.6.11, which was under summer vcation as summer vacation ended on 27.6.11) has covered under joining time and I will be granted only remaining 6 days for it.

    Please clarify me I will be granted how many days as joining time considering that I was relieved during summer vacation period.

I had selected for the post of Accountant in PAO. My previous pay scale was 5200-20200 with GP 2400 . the pay was 9110. Now in my present post the pay scale was 5200-20200 with GP 2800. the initial pay is here 8560 which is less than my previous pay. I had applied technical resignation from my previous department. But they donot mention tecnical resignation in release order. they only mentioned resignation from service. Now how my pay will be protected? What are the necessary documents/steps to produce for my pay protection. How the total service will be counted? My present department is provisional giving pay of fresh appointment. How I convince the department that since as per general rules i am not eligible for appearing in SSC 2010 due to my Old age? But due taking relaxation I applied for the post. Whenever SSC permitted and give me appointed order then What is doubt about technical resignation?

    1. i availed home town LTC for the block years 2008-09.
    2. i performed the journey between 14-1-2010 and 23-10-2010.
    3. i requested my office for 10 days EL encashment during october 2010. i have not taken any advance for ltc.
    4. i submitted my LTC claim during november 2010.
    5. my ltc claim was settled but 10 days el encashment was not paid.
    6. i requested my office orally and in writing for its payment several times.
    7. ultimately during September 2011 i received EL encashment amount.
    8. it was old rates of DA and basic pay.
    9. again i requested the office for payment of amount at my new basic pay and existing DA of 58%.
    10. i am informed that calculation was done when journey was done so question of encashment at new rate of basic pay and DA does not arise.

    kindly clarify whether my stand is correct in claiming for new basic pay and existing DA of 58%.

    I am an employee (civilian motor driver) of Indian Navy in Naval base Kochi. We are mostily doing night duties, but the night duty alowances are not paid to us stating that we are receiving over time alowances,but the OTA is not clamed for the period of night duty it is claimed only for the period of extra hours duty, after the compleetion of the normal duty hours. And also the OTA is paid @12.50/hr for the maximum of 53 Hrs.
    Sir I would like to know the latest ruls on night duty alowances and the rate of OTA for non-industrial staff as per new pay commission

    according to F.M.O.M dated 24-11-2008 and 27-11-2008 the pay scale of junior hindi translator is revised to 6500-10500.
    but my office said that this order is of no use because you have already geting 9300-34800 +grade pay 4200.
    in fixation they put my earlier scale 5000 * 1.86( which is already done at the time of sixth pay) they said that they cant put 6500*1.86 because this is upgradation of pay , and by rule only pre -revised pay can be calculated for pay fixation.
    sir, please clerify me that what is the pay fixation in my case.

    Kindly advise and guide regarding pay fixation in r/o employee X
    Employee X joined KVS as TGT-ENGLISH on September13, 1985 and the salary drawn by the employee X was @ Basic Pay Rs 440.
    The Basic pay of employee X was further fixed at Rs 1440 as on 1/1/1986 as per the revised scale of 4th Pay Commission with the date of next increment on 1/9/1986.
    Thereafter, the pay scales were revised w.e.f. 1/1/1996 and the basic pay of the employee X was fixed Rs 6025 in the pay scale of Rs 5500-175-9000 as on 1/1/1996 with DNI on 1/9/1996. Further discrepancy in pay in respect of employee X was found in relation to his/her junior and the same was removed by KVS fixing the pay of employee X at Rs 6200 as on 1/1/1996 with DNI 1/1/1997
    Employee X was granted senior scale w.e.f. 13/09/1997 and the basic pay fixed as on 13/09/1997 stands 6500 in the pay scale of 6500-200-10500.
    The year-wise calculation of the basic pay in tabular form upto 1/9/1998 is as under:

Due to revision of pay scales of Accounts Cadre, Pay scale of Jr. Accountant revised to 5500-9000 and further revised to 6500-10500 for 80% of sanctioned strength those who have completed three years. Now the post has been re-designated as Asstt. Acctts. Officer(AAO).
    My question is that as I have completed 10yrs. of regular service in the same post, Am I eligible for 3rd MACP with G.P.5400?

    I am a retired Scientist and an aggrieved pensioner. I have given below details with other particulars.


    Date of retirement & Pension date : 3.1.96 & 4.1.96
    Scale of pay of post held & last pay : 3700 – 5000 & 5000 (4 CPC)
    Scale of pay of post held & last pay : 12000 – 16500 & 13500 (5 CPC)

    Before 5 CPC, my pension was 1910. After 5 CPC, my pension was fixed at 5023.

    Surprisingly, this was far below the revised pension for junior officers.

    The revised pension for Pre 96 pensioners with 1910 corresponds to 5505

As a government employee I have applied through proper channel for two posts (which posts are purely on direct recruitment basis but not on deputation basis) i.e. UDC & Section Officer in two various government departments and subsequently I appeared for exams in both of them. Now I got the selection as UDC in new department but I am interested to join as Section Officer which result is pending at the moment. Now what my query is, without waiting for the result of Section Officer’s post if I joined as UDC in new department, and after passing of two to three months, if I get the selection as Section Officer in another new department, can I get relieved from my UDC post or not.

    So, please guide me what should I do now. Should I wait for the result of Section Officer’s post or without waiting for the result of Section Officer’s post should I join for the UDC post? If I should wait, then what is the procedure to take permission for not joining in UDC post at the moment? and Up to how many months can I get permission as per rules?

Then My Basic Pay was fixed as per rule 3275 Rs., But six pay commission recommended the one scale up to the Central paramilitary police force then my previous department i.e CRPF provide a Basic as on 01/01/2006 Rs.6460 and grade 2000 but my present department MOH&FW Fix as on 01/01/2006 Basic pay 6060 Rs. and grade 1900. So i want to confirm that what i m eligible for getting the Basic 6460 Rs.and Grade 2000 on 01/01/2006.

In case of a bundh or a strike that affects the transport and the employees cannot make it to their workplace... what proceedings can take place in case of applying leave for such unforeseen circumstances? (the distance we commute to school is more than 22 kms at a time.the same distance has to be covered on return)

    I am a central government employee joined as LDC in the year 1998 and after passing the Departmental exam, I was promoted as steno gr.III in the yr 2003 and after completion of 5yrs promoted as steno gr.II. I have come to this line to become an Inspector and so cleared my Department exams for Inspectors in the yr 2003 itself.
    On jan 2012 I have completed 2 yrs in gr.II cadreand as per the existing Recruitment Rules,2002 steno gr.II who have completed 2 yrs are eligible to become Inspectors. But during the year 2010, all steno gr.II were redesignated as steno gr.I and so after redesignation the Department says that we r only eligible to become Private Secretary. Our grievance is :
    1. we have passed the department exam for Inspectors
    2. All our seniors were given an option to become steno gr.I or Inspector but the same was denied to us.
    3. as per the board's proposal our juniors on completion of 2 yrs can become Inspectors but only our batch was left out.

Now, IGNOU has decided to implement Non-functional pay scale of Rs.8000-13500 to Section Officer on completion of 04 years services in Section Officer grade as per FR 22(I)(a)(2) wef 1.1.96 as per Government order. My basic pay is being fixed Rs.8000/-minimum wef 1-1-96 in Non-functional pay scale of Rs.8000-13500 in Section Officer on completion of 04 years services in Section Officer as per FR 22(I)(a)(2). Scale of Section officer and Assistant Registrar are same due to adoption of Non-functional pay scale of Rs.8000-13500.     As per recommendation of the VIth Pay Commision pay of Senior Secretaries who were in scale of Rs. 7t00 – 12,000/ (pre-revised ) should be upgraded to scale of Rs. 8000 – 13500/- (pre-revised on completion of 4 years services and their pay in the revised scale under VIth Pay Commission should be fixed at Pay Band II of 9300 – 34800/- with grade Pay of Rs. 5400/- Such recommendation was made by the VIth Pay Commission for Non-Secretariat Organisiations.

    The Govt. of India accepted the above recommendation made in para 3.1.14 of the Report and notified its decision thereon inhe Gazette of India (Extra-ordinary) part II, Sub-section 3(i), pp.44-45 No. 470 dated 29.8.08.

    I was promoted to the sadi post of Sr. Private Secretary in the pre-revised scale of Rs. 7500 – 12,000/- w.e.f. 31.5.2001. Thus I completed the required 4 years of regular service in the grade well before 01.01.2006 i.e. the date of revision of scale by VIth CPC. . As such I was entitled to the Grade Pay of Rs. 5400/- in the scale of PB-2. But surprisingly, instead of complying with the statutory order by allotting the Grade of Rs. 5400/- the authorities concerned of GSI allotted the lower Grade Pay Pay of Rs. 4800/- in the scale of the same PB-2.


    I made repeated appeal to the authorities but they have turned down my claim.
    So, I would request you to know me whether my claim is justified or not.

    I am working in a Central Govt. Office In Lucknow as Hindi translator in the scale of 5000-8000 since 1990. I was granted ACP in 2002 in the scale of 5500-9000. My scale was revised as per 6th CPC in the revised pay structure of PB-2 9300-34800 +GP 4200. Under MACP I was granted GP 4600 with effect from 1-Jan-2006.

    Ministry of Finance, Dept. of Expenditure vide their OM no. F.1/1/2008-1C, dated 24-11-08 had placed the post of junior hindi translator in the scale of Rs.6500 – 10500 PB2 w.e.f. 1-1-2006. Further Ministry of Finance Govt of India has granted grade pay of 4600 in the revised payband PB2 to posts that existed in the pre-revised scale of Rs.6500-10500 as on 1-1-2006 vide their order no. F.1/1/2008-1C dated 13-11-2009. Accordingly I think I must be given GP of 4800 w.e.f. 1-1-2006.

Beside the Posts of three Data Processing Assistant, there was one Joint Director EDP and one post of Programmer. When JD(EDP) retired in 1997 the post of JD(EDP) was abolished and the same was the case with the post of programmer. Since the Ministry could not fill the post for quite a long time as per the DOPT’s order the same was also diverted/abolished. So the future of these three DP Assistants became stand still as all the promotional avenues were blocked. Needless to say that in case the post of programmer was available in the Ministry we would have got first promotion in the scale of Rs.8000-13500 with grade pay Rs.5400.

    2. In the fifth Pay Commission our scale was made at par with that of Assistants i.e. 5500-9000 which is the entry scale. But in the year 2008 before the implementation of sixth Pay Commission when the scale of assistants was upgraded to 6500-10500(entry grade) we were given verbal assurance by the administration that our case will be dealt separately since being three DP Assistants only.

    3. Para 2 of section–1 of part-c of the notification of sixth pay commission recommendations also implies this point that the posts in the scale of Rs.5000-8000 and Rs.5500-9000 should be merged, with the post in the scale of Rs.6500-10500 being upgraded to the next higher grade in pay band PB-2 i.e. to the grade pay of Rs.4600 corresponding to the pre-revised pay scale of Rs.7450-11500. As per the above also we would have been granted the entry grade pay of 4600 and our first ACP would have been 4800.

    4. In the absence of any promotion we were given first ACP in the pay scale of 6500-10500. In sixth pay commission our pay should be fixed in the pay scale of PB-2 with grade pay 4800. Instead our pay was fixed in PB-2 with grade pay of 4600 thereby nullifying the effect of first ACP.

    5. In other organisations where the same technical posts exists and GP of 4800 was granted as first ACP to those who were in the pay scale of 6500-10500.

    Please suggest whether we are eligible for GP 4800 as our first ACP

    I was appointed as a HC/M (LDC Clerk)in CRPF on Fef 2006 and promoted as ASI/M on 08/2012. I had applied for Staff Selection Commission 2010 as a Gen candidate taking permisssion from my prior department. I have selected for the post of Sub-Inspector in SSB and rendered technical resignation from present post (CRPF) on 26/12/2011. I have join the SSB as a sub-Inspector on 12/02/2012 and at time of technical resignation I had drawn BP Rs.9460/-+GP Rs. 2800/-. Present post which I have joined as a Sub-Inspector with the pay scale Rs.9300-3488 and GP Rs. 4200/-.

    Sir I would like to know the entitle of pay fixation on my new post with rule position, due to I had also cross the initial pay of new post e.i Rs. 9300/- with the old lower post i.e Rs. 9460/-.

    Ministry of Finance, Dept. of Expenditure vide their OM no. F.1/1/2008-1C, dated 24-11-08 had placed the post of junior hindi translator in the scale of Rs.6500 – 10500 PB2 w.e.f. 1-1-2006. Further Ministry of Finance Govt of India has granted grade pay of 4600 in the revised payband PB2 to posts that existed in the pre-revised scale of Rs.6500-10500 as on 1-1-2006 vide their order no. F.1/1/2008-1C dated 13-11-2009. Accordingly I think I must be given GP of 4800 w.e.f. 1-1-2006.

Now I wanted to withdraw GPF for purchase of housing site at Hyderabad (my place of working) for construction of house. My CAO has rejected my application stating that withdrawal should not be granted twice for the same purpose. But my contention is first withdrawl is for purchase of flat and now for purchase of housing site both are different in nature. As per 15(1)(b) there are 6 occassion GPF can be withdrawl for one or more purposes. Please clarify whether I am eligible for withdrawl of GPF for purchase of house site.     I joined as L.D.C. in the previous department on 10/09/1987 on regular basis. Then I joined the other deptt. as L.D.C. (Hindi Typist) on 08/09/1993 after seeking revertion on transfer basis on my own request after submitting technical resignation (inter deptt./ministry transfer). Then I was selected /appointed as Jr.Hindi Translator (on-deputation basis) in the same deptt. as direct selection through Advertisement and joined the same post on 07/04/1997. I remained on deputation from 07/04/1997 to 01/11/2000. I was absorbed permanently to the post of Jr.Hindi Translator on 2nd Nov.,2000. I served the previous deptt. from 10/09/1987 to 07/09/1993.

DOPT has already cleared that the seniority has been delinked from the date confirmation on 04.11.1992.DOPT has already cleared under the rule of MACP that the service for granting MACP to be counted from the date of initial appointment not from the date of regularization i.e date of confirmation.     I am working at Teliamura, (near Agartala,Tripura) and my GP is Rs. 4200/-. I have posted to Agartala from my home town Kolkata. I reached Agartala by Air with my family (wife and 01 minor child). When I submit bill my office permit me to reimburse Air fare restricted to Train from Howrah to Guwahati (fare of AC-II tier) and by Bus from Guwahati to Teliamura (Rs. 550/-), but they have sanctioned me to claim only for myself & my wife and not for my minor child ( age appx 3 year) with the plea that no fare is required for child upto 5 years in train. But I have paid full Air fare of my son.
    Request clarify whether I am entitled to reimburse Air fare of my son during above transfer as well as during home town LTC or otherwise.
    An early reply in this regard is highly appreciated.

    • I was initially appointed as an LDC through SSC in the pre-revised pay scale of Rs.260-400/- and joined at Sena Bhawan, Naval HQrs, M/O Defence on dated 12/ 05/ 1982.
    • Soon after, I was appointed as an Investigator through SSC in NSSO, M/O Planning in pay scale of Rs. 425-700/- and joined on 23/08/83.
    • Thereafter, I was selected as a Research Assistant (Gr. B Non-Gazetted) through UPSC in the pre-revised pay scale of Rs. 1640-2900/- and joined in Doordarshan, M/o I & B on 11 /08/1992. This post of Research Assistant was re-designated and bifurcated according to seniority as Assistant Research Officer Gr.-I and Assistant Research Officer Gr.-II by the 5th CPC in the pay scale of Rs. 7500-12000/- and Rs. 6500-10500/- respectively.
    • The pay scales of Rs. 6500-10500/- of Assistant R.O. Grade-II recommended by 5th CPC have been implemented from 08 /08/2000 for Audience Research Staff, Doordarshan whereas 5th CPC pay scales are awarded since 01/01/1996 in all offices of Central Government.
    • First ACP was given to me since 11 /08/2004 with the pay scale of Rs. 7500-12000/- when I was working as a Assistant Research Officer Grade-II in the pay scale Rs. 6500-10500/- .
    • I got grade pay of Rs. 4800/- in the pay scale of Rs. 9300-34800/- since 01/01/2006 which was recommended by 6th CPC when I was working as a Assistant Research Officer Grade-II in the pay scale Rs. 7500-12000/-.
    • I have been promoted on 19/09/2011 as a Assistant Research Officer Gr.-I from Assistant Research Officer Grade-II and my grade pay remained the same i.e. Rs 4800/- in the pay scale of Rs 9300-34800/- . (ACP given on 11/08/2004 was regularized).

    • I have completed 30 years of Govt. Services on 12/05/2012; so I am eligible for 2nd & 3rd MACP in GP of Rs. 5400/- and Rs. 6600/-, which have not been granted to me so far.

    It is, therefore, requested that my entire service since 12/05/1982 may be counted for MACP purposes and I may be granted 2nd & 3rd MACP of G.P. Rs. 5400/- and Rs. 6600/- respectively. I hope that the matter may be taken up positively at the earliest possible. I shall be highly obliged for your consideration please.

    There has been no promotion since then.

    I got 1st ACP of 5000-150-8000 scale w.e.f 01-May-2000 (this is the next scale in my organization)

    Later I joined a post of 5500-175-9000(GP 4200) on 03 July 2007 under direct recruitment in the same organization.
    As I have applied through proper channel, I have tendered Technical Resignation to my earlier post.

    on a whole, I have been in the Grade pay of 4200 since May 2000.

    Am I eligible for 2nd MACP of 4600 Grade pay wef Sep 2008?

    I am desperately looking for your kind advice which is concerned to my pay fixation as new appointment after 01-01-2006.
    I have been appointed as scientist-I in pay band-3 (15600-39100; GP-5400) at the initial pay of 15600/- on 16th may 2011. Before that I was working as scientist II in same organization in the pay band 2 (9300-34400; GP 4600) at the pay of Rs 21460/- (pay band 16860 + GP 4600).

    On joining, I opted for the fixation of my pay at the date of next increment (DNI) i,e, on 1st July 2011. The competent authority has reduced my pay in the pay band from Rs. 16860 to 16060 and provided the total pay as such i,e, Rs. 21460 ( saying that my pay has been protected). On 1st July one regular increment also has been provided. However I feel my pay should be fixed as 16860 + 5400/- =22260/- on 16 th May 2011 according to the 6th pay commission concerned circular (N0. 12.3/2009-Pay-I; dated 30th march 2010). I strongly assume that pay protection implies that protection of Pay band + DA + applicable grade pay as well, with the best of my understanding based on previous pay commission fixation rules. How my already achieved last pay in the pay band Rs 16860/- can be reduced? I have achieved it due to 14 years of long service. I personally believes that reducing my pay in the pay band (16860 to 16060) is mis-interpretation of the concerned circular. Sir Please guide me what will be the correct pay.

    Subsequently, on an advertisement made in the inviting application from the eligible local candidates for filling up the post of Store Clerk in APWD . After the advertisement I had applied for the same and selected for an appointment to the post above by a duly constituted DPC and accordingly, I joined the post of Store Clerk on 17-08-1982. Consequent on joined the post of Store Clerk my services were condoned for the purpose of continuous regular service for the service benefits.
    On successful completion of more than 12 years service rendered in the post of Store Clerk, I was promoted to the post of Store Keeper on 24-11-1994 in the pre-revised scale of pay of Rs. 4000-100-6000.
    The post of Store Keeper in the Andaman PWD is an isolated ones, as there is no further avenues for betterment of service benefits to the incumbent as the other categories being enjoyed in the avenues and better service and monetary benefits down time to time.     MINISTRY OF FINANCE ‘s ORDERS GRANTING ONE TIME MEASURE INCREMENT ON 1.1.2006 FOR ALL OFFICIALS WHOSE INCREMENT FELL DUE BETWEEN FEBRUARY AND JUNE 2006 is not applicable to the retired employees between January to June,2006 which is great injustice and also for loss of one increment in fixation of pay as well as in pension compared to other employees although they were on service/ duty as on 01-01-2006 in the following case :-
    What about the case of a person whose annual increment was due between Feb to June,2006 ( last increment drawn in Feb- June,2005 ) but retired before the normal date of increment i.e. Feb-June, 2006? Whether such a person is also entitled to grant of one increment on 1.1.2006 since they were in service on that day (01-01-2006)? if not, such employees will be in a great loss compared to other similar category of employees whose increment is in the month of Feb-June 2006 and retired in July, 2006 & onwards as they will get two additional increments on 01-01-2006 & 01-07-2006 and also other consequent retirement benefit.
    Although, as per the confederation’s clarification it is APPLICABLE TO ALL GOVERNMENT EMPLOYEES AS ON DUTY ON 1.1.2006 AND WHOSE DATE OF INCREMENT WAS BETWEEN FEBRUARY AND JUNE, 2006 WOULD BE NOW GIVEN AN INCREMENT IN THE PRE-REVISED SCALE OF PAY AS ‘ONE TIME MEASURE’ AND THEN AGAIN REFIXED WITH ANOTHER INCREMENT IN THE NEW PAY ON 1.7.2006. ALL SUCH OFFICIALS WHOSE PAY WILL BE REFIXED W.E.F. 1.1.2006 SHOULD GET ARREARS AND OFFICIALS WHO RETIRED AFTER 1.1.2006 WILL GET THEIR PENSION UPWARDLY REVISED WITH ALL CONSEQUENTIAL RETIREMENT BENEFITS.

I have earned Family Planning Allowance in 1988 when I was working as Primary teacher (PRT) and I was getting Rs125 during 5 pay commission scales.6 CPC up graded the pay scales of teachers and the grade pay of PRT is Rs.4200.I got promotion as TGT in 2008 and my present grade pay is Rs4600. As I earned FPA when I was PRT ,I have to get FPA Rs400 corresponding to the grade pay Rs4200. but I am getting Rs.250 per month.
    Hence I request you to clarify How much amount is to be paid as FPA to me as per the latest rules of 6 Pay commission. Many teachers will be benefited they are also getting less than rates recommended by 6 CPC .

    I am working as TGT in kendriya vidyalaya sangathan.I earned FPA in 1988 when I was working as primary teacher(PRT).when the pay scales were revised as per recommendation of 5CPC,my FPA was revised to Rs 125.In 6 CPC scales teachers pay scales were up graded and the Grade Pay PRTs is Rs4200. After pay revision in pay scales recommended by 6 CPC, my FPA was revised to Rs 250 insted of Rs. 400 which is correspondin to the Grade Pay of PRT i.e. Rs4200 though I am working as TGT with greade pay Rs 4600. I represented my case to officers concerned.But they said it was granted as per rules.
    Hence I request you to clarify how to fix my FPA and for How much FPA I am eligible to get.Kindly consider my request and clarify as there are many cases like that of mine in our department.

    My Pay fixed in the new post (PGT) Rs.13,350 plus Grade Pay Rs.4800= 18,150/- i,e entry scale of PGT on 15/11/2006. The parent department should not allowed me higher responsibilities increment so far. where I am carrying higher responsibilities in the parent department till date. please clarify me whether I am admissible for higher responsibilities increment ? Please published your answer on your next monthly periodical.

    Now our department has conducted exam for gp 4200 for departmental personnel only, subsequently declared result with marks and made panel of only 25 people out of 53 passed candidate by adding APAR marks for last five yrs.i.e.good 6mrks,very good 8 marks & outstanding 10 marks e.g. Candidate scored 58(Exam Marks)+8+8+8+8+8 ( APAR Marks)=98 marks & prepared merit list accordingly and made cutoff at 98.Rest of candidate were not considered for panel.

    my questions are

    1)Can department hold another exam for same post when they are having 28 passed candidate with limited vacancies?

    2)If answer is no what can be done to avoid it?

    3)If answer is yes what would be the fate of 28 candidate?

One of my friend is working as a Class One officer in Indian Space Research Organization (ISRO) under Department of Space, Govt of India and from the joining date to till now he has been assigned in shift duty (the shift pattern is like blood circulation in the body: two days evening shifts from 1.30 pm to 8.30 pm, then two days morning shifts from 6.30 am to 1.30 pm, and then last two days night shift from 8.30 pm to 6.30 pm), losing health day by day with sleeping problem. What I want to know that under what circumstances Class-A officers will be assigned in such a blood circulation shift duty?????? In the joining letter it was mentioned that as being Class One officer you may work 24*7 hours, but here he is working year and years in round the clock shifts, this is quite irritating as per mentioned law being class one officer you may be called any time for the duty but not always in the such a way, and what I feel that there is no transparency because as a employer you know that particular Centers or Units is having shift duty then they should give information in the offer (joining) letter but they do not provide, if you ask how long officers will have to do such horrible shifts then bosses do not tell, and even threaten that you may lose promotions etc....... Many senior class one officers from years and years are doing continuous shift duties, and because of fear of promotions (so called performance based promotion in such R&D organization, true meaning of which is buttering of bosses, no utilization of talents), highly qualified guys are assigned as diploma holder's work.......how can such a great country like India be a developed country under these pathetic scenarios...............

    I have put in 14 years of service in postal department. I was appointed to clerical cadre on 01/03/1999. My problem is I had passed IP exam in 2007 and worked in the same cadre for about 2 years. But, owing to some personal problem, I declined from higher post [IP] to lower post [clerical] in July 2009. In March 2009, in clerical cadre I was due for 1st MACP promotion. I was deprived of 1st MACP on the grounds that I have taken unilateral transfer to a lower cadre on my own request. Further, I have been told that IP promotion comes under the scope of regular promotion for MACP. Hence, I will get 1st MACP on completion of 20 years when my batch mates will be getting 2nd MACP. i.e. I will be getting Rs. 2,800/- Grade pay on completion of 20 years whereas my batch mates will then be getting Rs. 4,800/- Grade Pay.
    Further, my pay in higher cadre is also not protected as I was given permission to decline subject to some conditions. Thus, I have been put into financial loss from both the sides. Hence, please clarify whether the decision taken by the administrative office in this case is correct. Also, please guide me under which rule I will be eligible for 1st MACP which is due to me from March 2009. If it is a anomaly, how can I get it solved?

We request you for some clarification on scale fixation from State(REC) to Central(NIT) The Superintendent Scale range (5000 - 10500) in the State was higher than the scale range (5000 - 8000) in central government. When we were in state we already reached near to 10000 scale in state government while in REC and after conversion to central government mapping into the then existing scale which was upto only 8000 and the rest of the amount was shown as PP for some time and later when gone into 6th PRC our PP was not included. When we asked in our accounts section we were told that there is no mention of such PP matter. Hence our humble request to you is to give some clarification over it and with along if any relavent GOs or OMs which were issued to correct such cases in the 6th PRC.

    However, in view of this, RA exam passed in CAG's office granted one increment without disturbing normal DNI; after than stepping up granted; later that my junior passed such RA exam passed in CAG's office & got increment;
    in lieu of this, my junior drawn more pay than me.
    Now my question is, my self & my junior both are passed RA exam; my self is granted RA exam increment before stepping up and my junior is granted RA exam increment after stepping up of pay.
    Now, anamoly occurs due to stepping up, my junior got more pay than me as he was cleared RA exam after stepping up.

    Pl. clarify my question sir,
    recently after implementation of 6th pay commission, three or four scales coming under PB2 (9300 + GP),
    after implementation, while promotion 3 % of the old will be increased. thereafter recently stepping up would be allowed in respect of direct juniors appointed in the same cadres.
    in lieu this, my junior direct employee has joined, accordingly my pay was stepped up to that extent. However, before stepping up, i have cleared incentive examination & allowed one advance increment and it should be no effect due to stepping up of my pay.
    Now, one more junior promoted employee, which pay was also stepped up to that extent of direct junior and thereafter such junior promoted employee cleared incentive examination & got one advancement increment.
    In lieu of this, though I have passed incentive examination before stepping up, my junior also cleared incentive examination after stepping up of his pay; my junior promoted employee drawn more pay than me.

    whether this is created anamoly or not? if yes give me suitable orders previously allowed cases and according to your opinion detailed clarification may furnished to my e-mail sir, gvs.20002001@gmail.com

    i was working in one of the UGC unit in the pay band 15600-39100 with grade pay 5400. i was selected as Director in the pay scale of 37400-67000 with grade pay 10000/-. i took lien and joined as Director. within one and half years my lien was withdrawn and i was ordered to report to my parent dept in the lower cadre. will my pay be protected? how is the fixation of my salary?

My junior who joined the same post/scale as of mine in the year 1996 was granted first financial up-gradation under MACP in the year 2009 is drawing more pay than me despite holding the same post.Kindly give me your valuable clarification via reply mail,weather I am eligible for stepping up of pay or not.

  348. Dear Sir, Previously working in MTPF(ordnance fty,Govt of India,Ministry of defence), Ambarnath--as CHARGEMAN in pay scale 9300-34800, GP-4200. I was on probation for 2 years. I completed 1 year & 8 months of service and got selected in Railways as Sr. Section Engineer in pay scale 9300-34800, GP-4600. I have given TECHNICAL RESIGNATION. In railways, I am getting stipend only i.e. Basic+DA; whereas similar peoples who where JE in railways are getting pay protection during training period also. i.e. they are getting special pay consiting of Basic+DA+HRA+TA during training period.
    Can I do not get this benefit of pay protection when central government job trasfer through proper channel from one ministry to other. If yes please help me providing some legal proofs which is required by railway officials.
    Also explain me what other benefits I am Eligible For-like NPS transfer, Earned leave transfer, Service record transfer.

  350. Dear Sir, I am employee in a Central Govt employee under Ministry of commerce Named coffee Board at capacity of not known LO/JLO in pay scale 9300-34800 with Grade pay 4200/4600. In fact it looks confusing yes sir it is in the state of confusion. during Jan 2009 i joined coffee board at capacity of junior liaison officer with grade pay 4200 in the pre revised scale of 6500-10500 scale.On a controversial order of coffee board the scale of Rs.5000-8000 and Rs.5500-9000 and 6500-10500 has been merged without thinking of functional difference but latter when GOI order has given a separate order to give 4600 to the pre revised scale of 6500-10500 then coffee board had forced to change the designation as Liaison officer and accordingly scale of entry pay has revised which resulted a hike of 5000 rupees in salary but the people who were in lower cadre went to kerala high court on the basis of previous controversial order and wined the case because poor defense. now the Board has taken the decision initially to roll back of designation and latter roll back of 4600 and so as scale of pay resulted 10000 to 12000 of loss of pay. we do not have any association and by reducing of salary along with recovery of 3 lakh has taken our slip (10 peoples) which in turn also became impossible to go to court. hence it is requested to give your suggestion how we can fight for the justice. please help me.

    When I was a Stenographer, granted two adv increments @ Rs. 30/- each with effect from 01.01.1991 for acquiring higher speed in shorthand at120wpm. Subsequent to the revision of pay from 1.1.1996, the rate of these increments have been revised to Rs. 100/-.

    Based on the award by Board of arbitration on 16.9.2005, DoPT vide OM dated 07.12.2009 conveyed that the advance increments granted to Stenos are treated as pay for all purposes.

    Subsequently, DoPT vide OM dated 06.12.2012 clearly issued the guideline on regulating the fixation of pay on merger of these increments for taking into account in the revised pay from 1.1.2006 or while fixing the pay on promotion/ACP.

    At the time of issue of DoPT 1st order on 7.12.2009, my pay was Rs. 5150+200 in scale of 5000-8000. Now I request you to suggest me whether I am eligible for fixation of pay taking these increments of Rs.200/- into account. If yes, from when it is to merged with pay.

    i m working as a lab tech in chc, in gujarat state government. i worked for 5 years under fixed pay and then after five years of completion of fixed pay service i got permanent on 11/1/2012 under new pension scheme. from then i have been in regular service upto 1st september 2012 and after that i took maternity leave of 135 days upto 13th december 2012 and then i used my earned and half pay leave upto 15th february 2013. then i was on EOL upto 31st july 2013. my query is that when will be my date of next increment as i have not got my increment till now neither on 1st july 2013 nor after joining my duty. and if i m correct i have completed 1yr full service from 11th january 2012 to 15th feb 2013. plz guide me my email id invincible909@gmail.com

  363. Sir, I have a question to clarify that, I was appointed as a CT/GD in SSB on 28/05/2007. Now I am HC/Min w.e.f 21/06/2012. During my pay fixation I have been granted one notional increment. My pay in the lower post during technical resignation was 7540/- and it was refixed by granting regular increment and one notional increment 8130/-.At present I am my pay scale is Rs. 8130+2400=10530/-. Is is correct fixation?

Without the permission he cann't claim the benefit of previous service and have to resign and join the new assignment.

    I joined New central govt. service on 02.04.2013 as an Auditor (Grade Pay Rs.2800) after giving technical resignation from my previous central govt. service of LDC . My previous basic was Rs.10340 and Grade Pay Rs.2800 after grant of 2nd MACP( i.e. completion of 20 years of service). Now my previous service has been counted and my basic has been fixed at Rs.10320 as per my previous service and was kept under old pension scheme. But increment due in July 2013 has not been granted to me by stating that for increment it is my new job.

  371. The PAO,GSI,NR,Lucknow has forfeited my total LTC Bill for performing a part of journey by private bus. In LTC private vehicle journey is not allowed. Commutation of journey by pvt. vehicle is not to be reimbursed, the rest part of journey is to be reimbursed as per CCS LTC Rule. Merely performing a part of journey by private vehicle does not entail forfeiture of total LTC claim. My LTC Bill is forfeited on 18 Oct, 2012. The PAO,Departmental officers and the officers of M/o Mines are silent to this injustice.DOPT and Dy. CGA's directives have been ignored. Many PG Portal regd. grievances have been disposed of without any logistic support. Can any one help me for restoration of natural justice.

Sir I am in central govt. office after permanet absorption from state govt. office and my MACP has been due in Oct/2012 but my MACP not yet granted on the clue of Point 9 &10 of Annexure-I of DOPT MACP order dtd.19/5/2009 that no past regular service rendered under state govt. will be counted for grant of MACP.
