OFFICE MEMORANDUM

Subject: Recommendations of 6th CPC in para 6.1.13 regarding lateral entry against identified SAG/HAG posts requiring technical/ Specialized knowledge.

The Sixth Central Pay Commission (6th CPC) have inter alia recommended in para 6.1.13 of its Report that some of the SAG and HAG posts in Government requiring technical or specialized knowledge and which are not encadred in any of the Service be identified and filled by suitable officers within the Government as
well as by the outsiders.

2. A copy of the relevant extracts of the recommendations of the 6th CPC is enclosed. The recommendations envisage that selection to such posts be through the UPSC and the Government employees applying for the posts, at the time of applying, be given the option to continue in the normal pay and allowances or receiving market driven salary, on selection. The objective is to ensure availability of
the best talent for these higher level posts in Government and to bring in a higher sense of participation among citizens.

3. The recommendations have been examined in consultation with Department of Expenditure and UPSC in this Department. UPSC agrees to make selection, in accordance with its mandate as given to it by the Constitution, for all posts so identified. However, selection methodology shall be worked out as and when the complete proposal specifying details of posts, duties attached to posts, qualification and experience required etc. are made available to them.

4. The various Ministries/Departments would need to carry out an exercise in this regard for identifying posts requiring technical/ specialized knowledge and examine the need for such contract appointment in the Ministry/Department.

5. A Note on guidelines for making contract appointment along with draft contract agreement is enclosed. It is requested that comments on the issue of having lateral entry into high level posts may be submitted to this Department by 15th July, 2013.

Revision of Pension as per 6th CPC Forms

 

Revision of Pension/ family pension of pre-2006 pensioners / family pensioners is being implemented in terms of Govt. of India O.M. No. F. No. 38/37/08-P&PW (A) dated. 01.09.2008 and No. 38/37/08-P&PW (A) Pt-1 dt 14.10.2008 in order to facilitate the above, pensioners / family pensioners in receipt of pension / family pension through Pension Payment Order  (PPOs) issued by Central Pension Accounting Office (CPAO) are requested to provide the following information to the Head of the Deptt/ Office from where the Government servant retired as soon as possible. It is urged that the information be provided within one month from the date of issue of Notification.

Subject:- Sixth Central Pay Commission's recommendations -
amendment of Service Rule..s. – regarding


This Department in OM No.AB1401716112008-Estt(RR) dated 24.3.2009 issued the guidelines for amendment of Service Rules/Recruitment Rules for incorporating the changes arising out of 6th CPC recommendations. Separately the revised eligibility conditions for SAG & HAG level for members of Organized Group A Services have been issued in this Department OMS dated 15.12.09 (Non-Technical) and 18.01.201 1 (Engineering Services). The provisions with regard to grant of functional scale of Rs. 14300-18300 (pre-revised) to the SEs and equivalent in respect of Engineering Services prescribed in OM dated 29.12.2010 also refers. Instructions for grant of NFU as per 6'h CPC recommendations have been issued in OM dated 24.4.09

2. As the Recruitment Rules/Service Rules are required to be amended after incorporating the above instructions, all the ministries / Departments / Cadre Controlling Authorities of Organized Group 'A' Services may take immediate necessary action for notification of Service Rules positively by 31.3.2012 in consultation with DOPTIUPSC 8 Ministry of Law.

Child Care Leave Clarification:

Acceptance of Recommendation of the Sixth Central Pay Commission relating to introduction of Child Care Leave. 

Department of Personnel Ministry Clarification:
Department's O.M. No. 14028/4/2009-Estt. (L) dated 7th September, 2010 on the subject mentioned above and to intimate that it has been decided in this Department to implement the decision of the Government, contained in the aforesaid O.M., to the members of the All lnclia Services mutatis-mutandis, pending amendment in the All lndia Services (Leave) Rules, 1955. 

Ministry of Urban Development:
It has been decided in consultations with Ministry of Finance to enhance House Building Advance, if applied for, may be granted for an amount equivalent to the difference between the previously sanctioned amount and the new amount determined on the basis of pay in the pay band, in past case, where HBA was sanctioned on or after 1-1-2006 but before 27-11-2008.

Sub: Interest bearing advance /Sixth Central Pay Commission recommendation on House Building Advance-enhancement in past – regarding
The undersigned is directed to invite attention to this Ministry's O.M. No. 1-17011/11(3\4)/2008-H.III dated 27th November, 2008 on the above subject and to say that it has been decided in consultations with Ministry of Finance to make the afore-said orders applicable with effect from 1st January, 2006. Accordingly, an enhancement of House Building Advance, if applied for, may be granted for an amount equivalent to the difference between the previously sanctioned amount and the new amount determined on the basis of pay in the pay band, in past case, where HBA was sanctioned on or after 1-1-2006 but before 27-11-2008 subject to complying following conditions:

(a) The Government servant should not have drawn the entire amount of HBA sanctioned under earlier orders and /or where construction is not completed /full cost towards acquisition of house /flat is yet to be paid.

(b) There will be no deviation from the approved plan of construction on the basis of which the original sanction of House Building Advance was accorded. The revised cost of the original plan can, however, be considered for determining the additional amount, subject to the prescribed maximum limits.

(c) Supplementary Mortgage Deed, Personal Bond and Sureties will be drawn and executed at the expense of the loanee.

(d) The actual entitlement will be restricted to the repaying capacity computed on the basis of the formula laid down in this Ministry's O.M. No. 1-17015/16/92-H.III. dated 17.10.2000. It should be ensured that the entire amount of advance with interest is recovered before retirement on the Government servant.

(e) Rate of Interest: The rate of interest chargeable in such cases would be as per the slab applicable to the total sanctioned amount i.e. amount already sanctioned on or after 1-1-2006 but before 27-11-2008 plus the enhanced sanction. However, the new rate of interest would be chargeable only on collective amount that would remain outstanding on grant of enhancement of HBA i.e., the unpaid portion of previously sanction HBA plus the enhancement so granted. Thus, the amount of HBA that has already been re-paid on old rates will not attract the fresh interest charges.

2. However, the existing limit of maximum admissible amount of Rs. 7.50 lakh for the purpose of construction /purchase of new house /flat and Rs. 1.80 lakh would remain unchanged. In other words, the sum total of previously sanctioned HBA and the enhancement granted under these orders cannot exceed the aforesaid limits. In nay case, not more than one enhancement is admissible to Govt. employees.3. The applications for enhancement HBA should be submitted within six months from the date of issue of this order.

4. Ministries/Departments whose branch offices are situated in the far flung areas like in case of Ministry of Defence, etc., are advised to give wider publicity to these orders through modern communication means like facsimile, e-mail, web-site, etc. so that there is no occasion for any representationfor extending the time limit of six months on the grounds of receiving these orders late.

HAG Scale Pay of teachers of CFTIs:

In consultation with the Department of Expenditure, it has been decided  to extend the HAG scale of Rs 6700-7900 /- without any Grade Pay in place of AGP of Its: 12000 / - per month. The AGP of Rs 12000 /- per month does not exist anymore.

 

CFTI-teachers-Pay Other conditions of eligibility to move to the above scale of pay will remain the same. Further the new scale of pay as indicated in MHRD letter of even number dated 26/08/2010 will have prospective effect from the date of issue of orders revising the scales of pay, i.e.  18/08/2009.

Subject:- Revision of pay of teaching and other Staff in Centrally Funded Technical Institutions (CFTIs) following the pay revision of the Central Government employees on the recommendation of 6th - Central Pay Commission (6th CPC).

I am directed to refer to this Ministry's order of even number dated 18th August, 2009 which inter-alia provided Professors in the Academic Grade Pay of Rs. 10,500 /- per month to be eligible to move to AGP of Rs 12,000/- per month subject to conditions stipulated therein.


It has now been decided in consultation with the Department of Expenditure to extend the HAG scale of Rs 6700-7900/- without any Grade Pay in place of AGP of Its: 12000- per month. The AGP of Rs 12000 /- per month does not exist anymore Other conditions of
eligibility to move to the above scale of pay will remain the same.

Sixth CPC recommendations - amendment of Service Rules

The Department of Personnel public grievances and Pension's  OM No.AB1401716112008-Estt(RR) dated 24.3.2009 issued the guidelines for amendment of Service Rules and  Recruitment Rules for incorporating the changes arising out of 6th CPC recommendations.

2. The 6th CPC have also recommended for bringing uniformity in eligibility criteria across various organized Group A Services for promotions. The issue has been examined and in the light of these, it has been decided that the following steps to amend the existing Service Rules shall be undertaken on priority basis:

(i) For promotion to SAG level, the eligibility requirement shall be " Officers in the JAG with 8 years' regular service in the grade including NFSG OR Officers with 17 years' regular service in Group 'A' posts in the service out of which atleast 4 years' regular service should be in the JAG (including service rendered in the NFSG of the JAG."
