Subject : Special Recruitment Drive to fill up the backlog reserved vacancies for Persons with Disabilities.
The undersigned is directed to invite attention to this Department's OM of even number dated idh December. 2008 whereby a Special Recruitment Drive was launched to fill up the backlog reserved vacancies of the persons with disabilities. The OM stipulated that reservation and backlog reserved vacancies would be determined on the basis of vacancies arising in the establishment in accordance with the instructions contained in this Department's O.M. No. 360351312004-Estt(Res) dated 29.12.2005. However, the High Court of Delhi in W.P.(C) No.l582812006 National Federation of the Blind Vs. UOI & Ors. held that reservation to persons with disabilities should be calculated on the basis of the strength of the establishment and passed orders for computing the quota and backlog of reservation as per their directions.

The All-India State Bank Officers Federation (AISBOF)  rejected the proposed 17.5 per cent wage hike and pension benefits and demanded a separate wage revision.

The Indian Banks Association (IBA) and United Federation of Banking Unions (UFBU) representing nine bank employee associations had agreed to the wage hike and pension benefits after a prolonged discussion in Mumbai.

"We do not agree with the proposed salary hike for bank employees. The SBI employees demand that the increase should be at par with the salary of the Central government employees," AISBOF vice-president SK Haldar said here"

In continuation to this Department's OM of even No. dated 27th March, 2009 and 22nd October, 2009 sanctioning the Dearness Relief to those Central Government pensioners who are in receipt of provsional pension or pension in thepre revised scales of 5th CPC, the President is pleased to grant the Dearness Relief to these Central Government pensioners as under:

1. Those who are in receipt of provisional pension or pension in the pre revised scales of 5th CPC are entitled to Dearness Relief @ 73% w.e.f 1.7.2009.

Pay hike for Govt employees in Bihar

Bihar state government employees heaved a sigh of relief on Tuesday amid speculation and wait when chief minister Nitish Kumar decided to the implementation of the Sixth Pay Revision report that was under the consideration of the state government.
 Nitish made this announcement after releasing his government’s annual report card on completing four years in office. "The government will take a decision soon and the employees will get their gift in the new year," he said.

Sub: Encashment of earned leave alongwith LTC -Clarification
The clarification is  to refer to DOP & T 0.M.No.310111412008-Estt.(A), dated 23rd September, 2008 allowing encashment of earned leave alongwith LTC and to say that various references are being received from MinistriesIDepartments with regard to the applicability of Rule 38-A of the CCS (Leave) Rules, 1972 to the Central Govt.employees.
In this regard it is clarified that

Subject: Clarification on Children Education Allowance
 The clarification is directed to refer to DOP&T O.M. of even No. dated 2.9.2008 on the above subject. Para l(c) of the said O.M. says "Reimbursement will be applicable for expenditure on the education of school going children only i.e. for children from classes nursery to twelfth including classes eleventh and twelth held by junior colleges or schools affiliated to Universities or Board of Education".

Sub: Central govt holiday on account of Bakrid

 
Central govt holiday on account of Bakrid will be observed on 27-11-2009 instead of 28-11-2009 in Kerala.

The Patna University (PU) Syndicate decided to implement the pay scales recommended by the sixth pay commission to its class III and class IV employees.  The Syndicate, at its meeting held  under the chairmanship of vice-chancellor Shyam Lal, discussed the demand of non-teaching staff in detail and decided to end the discrimination between the payscales of the government staff and the university staff.


Approving a resolution presented by Syndic Rajiv Ranjan Prasad, the Syndicate urged the ex-officio members, the HRD principal secretary and director of higher education, to attend the meetings of the Syndicate and Senate as the HRD department has of late been taking keen interest in the routine activities of the university. Usually these officials do not attend the meetings of various statutory bodies of the university.

It was intimated that for the welfare of persons with Autism, Cerebral Plasy, Mental retardation and multiple disabilities, the Parliament has passed the National Trust Act, 1999 ( NO. 44 of 1999). The Act provides , Intel- alia for Constitution of Local Level Committees and Appointment of guardian by the Local Level Committee in respct of persons suffering from the above sai disabilities. It was clarified therin that since the Guardianship Certificate issued unde the National Trust Act is based on the authoritiy of Law passed by the parliament , the same need to be accepted for the purpose of grant of family pension in respect of persons suffering from the disabilites as incorporated in the Act.

In the judgement dated 09-09-2011 in CA No. 5566 of 2008 (SLP (Civil)) No. 12357 of 2006) - UOI vs. Maj. Gen. SPS Vains HOn'ble Superme court has directed that the pay of all pensioners in the rank of Major General and its equivalent rank in the two other wings of the Defence Services be notionally fixed at the rate from 01-01-1996  and thereafer to compute their pensionary benefits on such basis with prospective effect from the date of filling of the writ petition.

While approving the Report of the Sixth Central Pay Commission, the Government referred the matter related to the demandsmade in regard to pay scales of certain common category posts of Pharmacists was one of the items referred to the Committee. The recommendation of the Fast Track Committee regarding the pay scales of the common category posts of Pharmacists has sincebeen reveived. The Committee has recommended that the entry grade of Pharmacists in Central Government should remain at grade pay of Rs.2800 in the pay band PB-1. However, on completion of 2 years service in the entry grade, all the incumbents should be granted non-functional upgradation to the next higher grade having grade pay of Rs.4200 in the pay band PB-1

Regarding introuduction of Non Functional scale of RS 8000-275-13500 to section officers of central Secratariate Service (CSS) and to say that the matter relating to pay fixation on grant of non-functional scale to Section Officers of CSS subsequent to implementation of CCS (Revised Pay) Ruls, 2008 has been considered in the Departmental of Personnel and Training in consultation with the Department of Expenditure.

The pension contribution payable in respect of a Government servant during the active period of his foreign service shall be based on the maximum of the pay as defined in Rule 9(21)(a)(i) of the Fundamental Rule of the revisedpay scale of the post held by a Government servant at the time of proceeding on foreign service or to which he may receive proforma promotion while on foreign service.

Regarding the Modified Assured Career Progression Scheme (MACPS) Consequent upon the implementation of Sixth Pay Commissions recommendations, the four pre-revised Group 'D' pay scales viz., Rs.2550-3200, Rs.2610-3540, Rs.2610-4000 and Rs.2650-4000 have been upgraded and replaced by the revised pay structure of grade pay of Rs.1800 in the pay band PB-1. As per the recommendations of Sixth Central Pay Commssion.

 The Corporation of the City of Panaji (CCP) informed the high court of Bombay at Goa that it has decided to pay the salaries to its employees as per sixth pay commission.

CCP's advocate Agnelo Diniz told the court that CCP officials have communicated to him that the employees would be paid their salaries as per the Sixth Pay Commission's recommendations.

Earlier according to which encashment of leave in respect & central Government employees will be considered both for earned leave and half pay leave subject to overall limit of 300 days and in respect of encashment of half pay leave, no reduction shall be made on account of pension and pension equivalent of other retirement benefits. In case of shortfall in earned leave, no commutation of half pay leave is permissible. The order was made effective from the lSt September, 2008. The matter was reconsidered in this Department in consultation with the Department of Expenditure (Implementation Cell) and it has been decided to modify the date of effect of this Department's 0.M of even number dated 25th September, 2008 to "O1.01.2006 instead of 01.09.2008 subject to the following conditions:-

Pay hike for Tamilnandu Electricity Board (TNEB) employees

After implementing the recommendations of Sixth pay commission for Government employees and teachers, the ruling DMK Government has shown its largesse to yet another large section of working class- employees and officers of Tamil Nadu Electricity board (TNEB) with a 40% hike in wages and allowances.

The Government on Monday announced revision in pay and allowances ranging from Rs 1400 to Rs 19510 per month across various cadres in TNEB from Mazdoors to chief engineers

Jammu and Kashmir Chief Minister Omar Abdullah has said his Government is ready to release the pending salaries of the Jammu and Kashmir State Road Transport Corporation (SRTC) employees.


“I am ready to release the pending salaries of employees of SRTC. As for the Sixth Pay Commission, they (employees) can only get benefits if the Corporation is made profit earning. How can we give them the Sixth Pay Commission benefits, when Corporation is a loss-registering one,”
 

Poor NPS subscribers will not get Tier-II account

Subscribers of the low-cost version of the New Pension Scheme (NPS), called CRA Lite, will not be allowed to open a second savings account unlike normal subscribers. The tier-II account, to be operational from December 1, will facilitate withdrawals but require a minimum balance of Rs 2,000.
 CRA Lite customers will enroll for the scheme through self-help groups (SHGs) and pay less than one-fourth of the charges paid by a regular NPS subscriber. The SHG will open a main account under NPS. There will be sub-accounts for people from low-income group under this account. They will have to pay Rs 30 for the permanent retirement account number (PRAN) card, against Rs 50 paid by other customers.

Resentment is prevailing among the retired railway employees as they are not getting the revised pension as per the recommendations of Sixth Pay Commission, asserted SK Singh, president of United Forum of Pensioners Association while addressing a meeting.

He also said that retired employees of many Central government departments are not getting the revised pension due to the callous attitude of the authorities concerned.

The government is moving fast on pension reforms. While the finance ministry is ready to take the Pension Fund Regulatory and Development Authority (PFRDA) Bill to the Cabinet for approval this week, interim pension regulator PFRDA has drawn up a multi-pronged strategy to expand the reach of the new pension scheme (NPS).


The PFRDA Bill, floating in suspended animation since the NDA regime, is on the finance ministry’s priority list for introduction and passage in upcoming Winter Session. The ministry is also considering PFRDA’s proposal to grant annual incentives to intermediaries selling NPS to help propagate the retirement savings habit in India’s 400 million-plus workforce, 90% of whom have no social security net.

All citizens of the country can now buy a pension plan at retirement age with the pension regulator increasing the maximum age for entering the new pension scheme (NPS) from 55 years to 60 years.

The decision was taken at the last board meeting of the Pension Fund Regulatory Development Authority (PFRDA). NPS, earlier restricted to government employees, was opened to all citizens up to 55 years of age on May 1. The regulator decided to increase the maximum age after many people nearing their retirement age showed interest in joining the scheme.

The undersigned is directed to say that consequent upon acceptance of the recommendations of Sixth Central Pay Commission, the deputation (duty) allowance shall be restricted as under: "Basic pay, from time to time, plus Deputation (~utyA) llowance should not exceed the maximum of the pay band PB-4 (Rs. 67000) plus the grade pay of the post held on deputation subject to the grade pay not exceeding Rs. 10,000. The term 'basic pay' in the revised pay structure means pay drawn in the prescribed pay band plus the applicable grade pay but does not Include any other type of pay like special pay, etc."

OFFICE MEMORANDUM

Subject: Grant of incentive for acquiring higher qualification - Inclusion o f additional qualifications/Review of the qualifications listed in the Annexure to this Department's OM No. 1/2/89-Estt(Pay-I) dated 9.4.99.

Patna High Court  directed the state government to enhance the salary structure of the employees of civil courts in the state and make it commensurate with the one recommended by the Sixth pay commission for central govt employees.

A division Bench, comprising acting Chief Justice Shiva Kirti Singh and Justice Shyam Kishore Sharma, issued the directive on a representation of the Association of State Civil Court Employees, treating the same as a writ petition.

While instroducing the New Pension Scheme from 01/1/2004, amedments to various existing rules including Rule 2 of the CCS ( Pension ) Rules, 1972 were made whereby these rules became inapplicable to those appointed to Central Govt services and postf from 01/01/2004. Also the new and changed position obtaining on mobility of personnel between central government departments between central and state governments; and between Govt departments and autonoumous bodies on technical resignation from 01/01/2004 under these rules were clarified vide OM of even number dated 26/07/2005.
